Hello[edit]
hi, all your image uploaded with this description : English: Scanned image from personal collection - photograph is former SLC president Marion Coats.
look to me as copyright violations : you are not their author, and cant claim copyright ownership over them and license them GFDL & CC BY SA 3.0
--Lilyu (talk) 00:34, 2 October 2008 (UTC)
- Yes, but you didn't took the photo, the copyright laws apply to the author of a photo. If he didn't gave you the right to redistribute the image, you cant do it, and absolutely not re-license it under GFDL & CC-BY-SA.--Lilyu (talk) 01:01, 2 October 2008 (UTC)
- It's just like when you buy a computer : you can resell it or give it away, but you cant start producing this type of computer. Cause it's protected. It's the same thing with your photos, you can resell or give away the sample you own, but not starting to sell post cards with it on them, nor uploading it on Wikimedia commons, i'm sorry. "Own work"[edit]
Scanning someone else's photo does not make it your own work. No way no how. It remains the work of whoever took the photo originally. Please correct the information of any images you uploaded with mistaken information. I'll assume you somehow didn't understand this point before; now you do. Note that uploading images with deliberate false authorship or licensing claims can result in the uploader being blocked, so please be careful to get things right. Take a look at the links in the welcome message near the top of this page, and if there are questions you can't find the answer to, feel free to ask. Hope this helps. -- Infrogmation (talk) 11:53, 4 October 2008 (UTC)
An example on that point-- the image below needs info on the actual source-- who took the photo, when?:
Image Tagging Image:SLCPaulWard.JPG[edit]
Thanks for uploading Image:SLCPaulWard.JPG. I notice the image page currently doesn't specify who created the content, so the copyright status is unclear. If you have not created this media yourself then you need to argue that we have the right to use the media on Wikimedia Commons (see copyright tagging below). If you have not created the media yourself then you should also specify where you found it, i.e., in most cases link to the website where you got it, and the terms of use for content from that page. If the content is a derivative of a copyrighted work, you need to supply the names and a licence of the original authors as well.
If the media also doesn't have a copyright tag, then you must also add one. If you created/took the picture, audio, or video then you can use {{self|GFDL|cc-by-sa-all}} to release it under the multilicense GFDL plus Creative Commons Attribution-ShareAlike All-version license or {{PD-self}} to release it into the public domain. See Commons:Copyright tags for the full list of copyright tags that you can use.
Note that any unsourced and untagged images will be deleted one week after they have been uploaded, as described on criteria for speedy deletion. If you have uploaded other media, please check that you have specified their source and copyright tagged them, too. You can find all your uploads using the Gallery tool. Thank you. Old photos[edit]
Thanks for your note on my talk page. It sounds like you've got a nice collection of old photos, and I think it's great you want to share them. Please understand that Wikimedia Commons is a project specifically for useful photos that are demonstrably free for reuse (eg public domain or licensed under Creative Commons, GFDL, etc), so there's a reason why policy is to be stringent about copyrights. You can find more details by spending some time looking at pages linked from licensing and related links in the welcome message, but here's a few points you might find useful for a start. For US works, it has to be from before 1923 to assume it is public domain. Lots of stuff more recent may be public domain as well, but if its from 1923 or later you generally have to have more informoration (eg, on source/authorship, if it was ever copyrighted and if that copyright was renewed). Personal photos you inherited are your property to reproduce and license IF you can be sure that no one else holds a copyright on them. For example, if the photo was taken by your grandfather and you inherited it after his death, and there are no conflicting claims to copyright (eg, he wasn't selling the rights to the photos to a magazine or company and no other relative has a claim on them)-- you can license it as you see fit (though authorship credit should still go to the original creator of the work if possible). If you inherited some photos that you don't know who took, that's more of a problem. For example Image:SLCprotestBronxvilleNY.JPG is a beautiful photo with historic value that I'm sure would be a great addition to Commons if it is shown to be free licensed. However at present I can't tell if it is. Who took the photo? Are they still alive and retain rights to it, and if not does someone else have those rights? Was the photo ever published? Might the photographer have sold rights to the photo to a newspaper, or magazine, and for example might the copyright now be owned by a corporation like Associated Press? I hope this example illustrates why Commons needs information. If you don't have enough information about the photos to tell if they're copyrighted, sorry but Commons isn't a good place for them. However I suspect there might be other places to share them-- perhaps check with Sarah Lawrence College or with the public library of the area-- do they have websites with historic photos? Or perhaps some blogs or flickr.com.
Thanks for wanting to share interesting photos and sorry if things here have been a hastle for you. I hope this helps some. Cheers, -- Infrogmation (talk) 18:06, 4 October 2008 (UTC)
