Доброго дня.

Прошу вас зняти шаблон претензії, та надати мені дозвіл використання File:Святе Письмо (Spain-1990).djvu для Української Вікіпедії в ілюстрації статті про "Святе Письмо" вже завантаженого на Wikimedia Commons. Або порадити в нижче наведеній ситуації який використати шаблон для уникання претензій.
Оскільки цей файл був мною отриманий з "Святе Письмо [Біблія] (1990) [djvu] | Оцифровано Гуртом (є стаття в УкрВікі про цей сайт "Гуртом")" (завантажив туди почесний оцифрувальник літератури yf Гуртом - з нік-неймом taras1994), адреса звідки даний файл взято - http://toloka.hurtom.com/viewtopic.php?t=37610 У зв'язку з чим повідомляю, що я маю паперовий екземпляр даної книги, на якому не міститься значка "авторське право". Більше того, на початку даної книги міститься запис "Дар не на продаж" (не комерційний випуск для таких вимог). Дана книга є у суспільному надбанні (як і любий текст Біблії) або не захищається авторським правом дана книга. Крім цього, мною це завантажено сугубо для статті Святе Письмо. --Krupski Oleg (talk) 13:53, 4 February 2014 (UTC)

Ну так якщо не на продаж, тоді це заборона комерційного використання, а для Вікісховища воно має бути дозволене, див. Template:Noncommercial.--Anatoliy (talk) 13:58, 4 February 2014 (UTC)
  • Там не написано "заборонено продавати" для ВікіСховища. І до чого ваше тенденційне видалянство, схильність тільки знищити при очевидній користі файлу з непорушними авторськими правами на теренах США? Прошу порадити відповідний шаблон для користування цим файлом всіма україномовними читачами Вікіпедії --Krupski Oleg (talk) 21:22, 4 February 2014 (UTC)
    Я не дивлюся на користь, я спершу дивлюся на ліцензійний статус файлу. У нас сервери і Вікісховища, і Вікіпедії розташовані у США, тому і керуємося законодавством США.--Anatoliy (talk) 21:26, 4 February 2014 (UTC)

Це Вікісховище, багатомовний проект. Тут людей за мовами не дискримінують, відповідно і правила однакові шо для іспаномовних, шо для есперантомовних, шо для монголомовних, шо для інших користувачів. Перепрошую, що втручаюся, але згідно з Бернською конвенцією, ця книга захищена авторським правом незалежно від того, стоїть там знак копірайту чи ні і чи вказано там ім'я перекладача. --DixonD (talk) 09:24, 5 February 2014 (UTC)
Конкретно яка стаття (артикул, параграф), щоби перевірити вашу тезу? Бо в статті Бернська конвенція про охорону літературних і художніх творів мовиться (розділ "Зміст"), що увага США є до "зареєстрованих" творів (з міжнародним знаком "Copyright"), а надруковано дану книгу без "Copyright" - в 1990 р. в Іспанії (в 2014 р. розміщено на сервері файл з тої книги), якщо йдеться про сервер... --Krupski Oleg (talk) 13:57, 6 February 2014 (UTC)
Зі статті у Вікіпедії: "Авторське право за Бернською конвенцією повинно набуватись автором автоматично, тобто воно не потребує формальної реєстрації." Це другий пункт статті 5 конвенції. --DixonD (talk) 15:57, 6 February 2014 (UTC)

Це не має значення, оскільки Сховище не приймає сирітських творів "Надрукований в 1990 р. незмінним текст книги є більше як 100 років.." - не зрозумів цю репліку. --DixonD (talk) 16:22, 6 February 2014 (UTC)
А взагалі - це переклад Івана Хоменка, який помер у 1981. Навіть за Бернською конвенцію, яка встановлює лише мінімальний термін дії авторського права, воно сплине не раніше 1 січня 2032, а на практиці довше у більшості країн. --DixonD (talk) 16:29, 6 February 2014 (UTC)
  • До чого тоді ваша репліка про статтю № 5??? Якщо для дії ст.5 (на вашу думку) не зазначено імені перекладача в книзі, а пишете його прізвище зараз ви (бездоказово помітьте - жодних авторитетних вказіваок що саме це видання в Іспанії є від перекладу Хоменка). Книга має лише данні про друкарню. У мене є паперовий та електронний варіант для відстоювання моєї точки зору. --Krupski Oleg (talk) 06:54, 7 February 2014 (UTC)

Монумент Вітчизни-матері not FOP

Hello Anatoly,

I hope not to bother you, most watching the problems you are having theese days in Ukraine.

I received yesterday two proposals of deleting of my pictures of Монумент Вітчизни-матері from Kulmalukko (talk) . According to his opinion (and I am pretty sure he knows what is doing) this monument is not FOP (Free of Panorama) according to Ukranian laws, because the Statue is made about 1981 and it is still protected by intelectual property laws.

Perhaps there is some special status for this statue, according for the special meaning to the people of Ukraine, or perhaps I have to request a permission to publish it...

Deletion Request

I don´t know if you or somebody in Wikimedia Ukranie can help about this (not for me, to have picture deleted is not a problem for me if the picture is not according to Wikimedia requeriments, it is about all the pictures of the Statue that are requested to delete)

Sorry for bother you, most in this moments of crisis in Ukraine. I strongly hope the problems will be solved in peace. A great country you have.

Concerning special status, it has indeed a special status (a historic monument), but nothing more. There is currently no exemption for historic monuments from FOP in Ukraine, thus not many legal ways to keep this. Basically, the major options are:
  • Seeking permission from the author's daughter (the author is Vasyl Borodai and his daughter is Tetyana Boroday). I am not sure she would eagerly provide permission, as the author (when he was alive) was known to be almost the only one in Ukraine to enforce copyright on photos of his works, but probably it's worth a try
  • Convincing Ukrainian lawmakers to add FOP exemption to the Ukrainian copyright law. It is very unlikely to happen at the moment, but maybe one more faction — this time Communists — will be convinced that this change will at least help save pictures of Soviet monuments — NickK (talk) 22:44, 7 February 2014 (UTC)

Wikimedia Commons is happy to announce that the second round of the 2013 Picture of the Year competition is now open. This year will be the eighth edition of the annual Wikimedia Commons photo competition, which recognizes exceptional contributions by users on Wikimedia Commons. Wikimedia users are invited to vote for their favorite images featured on Commons during the last year (2013) to produce a single Picture of the Year.

Hundreds of images that have been rated Featured Pictures by the international Wikimedia Commons community in the past year were entered in this competition. These images include professional animal and plant shots, breathtaking panoramas and skylines, restorations of historical images, photographs portraying the world's best architecture, impressive human portraits, and so much more.

There are two total rounds of voting. In the first round, you voted for as many images as you liked. The top 30 overall and the most popular image in each category have continued to the final. In the final round, you may vote for just one image to become the Picture of the Year.
