Moin! Oftmals ist die abgebildete Person NICHT der Urheber. Selfies ausgenommen. Das Deutsche Urhg. ist ziemlich genau bei der Uebertragung des Urheberrechtes: Nur durch Erbfolge möglich, das Urheberrecht kann NICHT einfach übertragen werden. Der Fotograf MUSS sein Einverständnis erklären. Ob das Foto im Internet rumgeistert oder nicht spielt keine Rolle. In D-Land ist alles ein wenig komplizierter! Also: Nicht als Eigentum deklarieren, sondern den Fotografen weichklopfen. Vielen Dank, Hedwig. Was bedeutet weichklopfen? Soll er das Bild selbst hochladen? Oder soll er mir eine schriftliche Erklärung schicken oder an Wikipedia? Oder reicht vielleicht eine mündliche an mich? Tatsächlich hat der Fotograph auf einer Party den Porträtierten fotografiert und ihm die Bilddatei samt der Rechte an dem Bild sofort abgetreten. Jetzt bittet mich der Porträtierte das Bild für seine WP-Biographie zu verwenden. Gibt es da eine unbürokratische Lösung? Die Biographie Bernd-Uwe Jahn habe ich übrigens schon hochgeladen, und sie wurde nach Sichtung erst mal akzeptiert. — Preceding unsigned comment added by Φως (talk • contribs) 14:12, 4 November 2017 (UTC)[reply]
Nein, er kann die Rechte nicht abtreten. NUR per Erbschaft möglich, siehe § 29 Abs. 1 UrhG auf dejure. Nuzungsrechte allein erlauben nicht das Foto frei zu lizenzieren.
Schau mal hier: OTRS. Das MUSS der Fotograf erledigen, niemand sonst kann diese Erklaerung abgeben. Das meinte ich mit weichklopfen. Wer das Foto letztendlich hoechlaedt ist egal, solange die Genehmigung per OTRS vorliegt. Eine mündliche Genehmigung oder eine weitergeleitete Email sind nicht ausreichend.
