Image deletion warning Image:Dandels.jpg has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this image, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. If the file is up for deletion because it has been superseded by a superior derivative of your work, consider the notion that although the file may be deleted, your hard work (which we all greatly appreciate) lives on in the new file.
In all cases, please do not take the deletion request personally. It is never intended as such. Thank you!

Do you have a better version of Image:Dandels.jpg?

Thank you for your submission of Image:Dandels.jpg. While all submissions are useful, do you think you might be able to supply a better quality version of the same, or similar, content? In many cases, the largest and highest resolution possible is the most useful version to have available. (MediaWiki has automatic resizing functionality, so there is no need for multiple versions of the same image at different sizes, users can select any size and the software will generate and cache the needed resolution on the fly.)

If you can supply the same exact image as Image:Dandels.jpg at a larger resolution (or media at a higher bitrate, etc.), please just upload it over the original, users will get the new higher quality version with no further effort on your part. If on the other hand, the content is only similar, it is best to select a new image name, as there may be uses already where some aspect of the existing media was key to the usage. In the latter case, if you can provide a crosslink reference to the new image in the older one and vice versa, that will be extremely helpful.

Again, thank you very much for your contribution, it is appreciated. Siebrand 22:42, 7 July 2007 (UTC)[reply]

Thanks for telling your opinion about the image in question. I fully agree that it is not a photograph of particular value regarding the potential use by others. It's actually a small section of a bigger image showing a spring meadow with millions of dandelions in full blossom. I prepared this section for decorating my little personal homepage and now want to use it for the same purpose on my recently created Wikipedia user page Wikihawk. I can upload the orginal digital photo (1280 x 960 px) under a slightly modified filename if this helps to avoid deletion of the current image but it would take me a couple of days to find the former in my badly organized computer archives. Looking forward to your kind response -- Wikihawk 02:48, 10 July 2007 (UTC)[reply]

Hello, and thank your for sharing your files with Commons. There seems to be a problem regarding the description and/or licensing of this particular file. Please remember that all uploads require source, author and license information. Could you please resolve these problems, which are described on the page linked in above? Thank you. --Siebrand 12:30, 11 August 2007 (UTC)[reply]

Another problem - this is a picture by one David Barker. From what I gather on your User page link, you are not David Barker. Do you have an e-mail explicitly stating that the image has been released under the GFDL license for use in all Wikimedia projects? If not, I'm afraid that this is yet another copyright violation. Pandacomics 16:15, 8 September 2007 (UTC)[reply]
As for the licence of the image posted in the infobox of the article en:Vivian Hsu, I can confirm that I have got the written agreement of David Barker to use it under the terms of the GNU Free Documentation License (GFDL). Here is the text of his e-mail:

I have forwarded this mail to Wikimedia Commons together with the Upload of the image in question and received the following reply on August 11th 2007:
We have received the permission for the image and have updated the image description page accordingly. Thank you for your contribution to Wikimedia Commons!
Yours sincerely,
Riana

I hope this will clear up the doubts about origin/permission of the image. --Wikihawk 21:01, 8 September 2007 (UTC)[reply]

--Shizhao 01:58, 28 November 2007 (UTC)[reply]

I cannot make out a convincing reason for the deletion request. Shizhao may have missed that a clear GFDL by the creator/owner of the photo in question is provided (see my previous entry in this talk page) --Wikihawk 09:08, 28 November 2007 (UTC)[reply]

I have reviewed the text above and the OTRS ticket but neither refers to this specific image, namely Image:Vivian portrait.jpg, so at the moment I see no alternative but to deletion. Would you like to see if you can persuade the copyright owner to do a similar GFDL release to those mentioned above? If you can let me know when the OTRS permission email has been sent I will check for its arival and if it's ok close the deletion request. In the meantime I have noted that the deletion request should be held open for another week. --MichaelMaggs 06:32, 22 May 2008 (UTC)[reply]

First of all I would like to inform you that I appretiate and respect the necessity for images used in Wikipedia articles having to comply with strict rules concerning authorship and copyright. The image being in discussion here is used in an article about Vivian Hsu. In the past months I have thoroughly worked over this article, setting several details right, eliminating inessential parts and removing statements that may violate the rules for articles about living persons. Furthermore I considered to provide a portrait photo of Vivian Hsu and photographer David Barker was so kind to send me a selection of seven appropriate photos along with personally approved GFD licence - however he wished that his name should appear in some apt form on the Wiki entry. I will upload the complete image set to Wikimedia Commons within the next days so that the administrative team can check the material. I'm assuming that these images fulfil the requirements regarding the copyright and are allowed to use them in Wikipedia as long as the files have been tranferred to Wikimedia Commons without any modifications. On the other hand I found somewhere in the huge Wiki help compendiums that images should not contain textual watermarks in certain cases. So I decided to select one of the seven photos suitable for removing the watermark (www.davidbarker.com) by image post-processing. Before uploading and inserting the portrait into the article (with his name in the image legend) I asked David Barker again and he gave me his consent (the e-mail correspondence can be shown here if required). From the current image deletion discussion I understand that the given GFDL has been lost after the described modification of the picture in question. Currently I could imagine two possibilties for a solution of this problem: (a) I would use one of the seven photos unchanged. On the article page the watermark will become almost illegible anyway since the image is displayed down-scaled to 220 px width - a way that I would prefer. (b) I would keep the current picture but declare myself for the copyright holder and release it to the public domain. The legend would then read as "Credits to David Barker" rather than "Photo by David Barker". Unfortunately I don't belong to the well-versed Wikipedians - my wish is only to care for an acceptable and sufficiently founded article about this talented actress and singer Vivian Hsu from Taiwan. Of course it's impossible simply to visit her in order to take my own photos - so I would like to ask you for your kind assistance in order to have one of David Barker's beautiful portrait shots for the article. --Wikihawk 13:08, 23 May 2008 (UTC)[reply]

Hi, thanks for the reply. There may not be a big problem, since in fact the GFDL does allow modifications to be made, including cropping. So, if David Barker has indeed released his original version of this image under GFDL, the cropped one will be ok as well, still listed as being under his licence (if the only change you have made is to crop, that wouldn't give you any copyright of your own, and neither would you be able to release your cropped version to the public domain since David Barker still retains his copyright). Although his name no longer appears on the face of the cropped image, it will still appear on the linked discussion page as the copyright owner (which is allowed under the terms of the GFDL).

The issue is that the original uncropped image (since deleted) from which you created Image:Vivian portrait.jpg was uploaded to Commons under the name "Image:Vivian Hsu portrait.jpg". No image of that name was mentioned on the email that you sent to permissions-commons@wikimedia.org, and which you quoted above. That listed seven photos, none of which was Image:Vivian Hsu portrait.jpg.

I have undeleted Image:Vivian Hsu portrait.jpg, pending permission, and I'd be grateful if you could ask David Barker to send an email directly from his own email address to permissions-commons@wikimedia.org confirming that he wishes to release that image under GFDL. Please ask him to mention in the email the name of the original photo, "Image:Vivian Hsu portrait.jpg". If he also mentions my name, I'll pick up the email from the OTRS system and assuming the release is OK will add the appropriate tags to both Image:Vivian Hsu portrait.jpg and Image:Vivian portrait.jpg. Hope that makes sense. Let me know if anything's not clear. --MichaelMaggs 16:27, 23 May 2008 (UTC)[reply]

Thank you for your supportive explanation. Meanwhile I have uploaded the seven photos which David Barker has released under the terms of GFDL: Image:Vivian1comp.jpg, Image:Vivian2comp.jpg, Image:Vivian3comp.jpg, Image:Vivian4comp.jpg, Image:Vivian5comp.jpg, Image:Vivian6comp.jpg, Image:April16vivian7comp.jpg. As you can see the image in question Image:Vivian portrait.jpg has been created from the the first original in the list above. In fact I have cut out a quadratic section from the middle of the original and did a minor retouch in order to let the rest of the watermark disappear. If I have understood it correctly the modified image can now be used under the same licence as the original. Is that correct or is there still a need for another written permission by David Barker? In any case Image:Vivian Hsu portrait.jpg would not be needed anymore and can be definitely deleted. --Wikihawk 01:14, 24 May 2008 (UTC)[reply]

Great, that makes all the difference. I don't have time just now but this evening I'll tag them all up with the proper OTRS tags, and everything should then be fine. Thanks for bearing with me while we went through this copyright stuff. --MichaelMaggs 08:10, 25 May 2008 (UTC)[reply]
