I’m trying to determine the copyright status of this portrait. I was wondering if you would know about it as you seem to physically own it. If this work was ever published, it is in the public domain because it was published in the US before 1928. However, if it wasn’t published, one of these needs to be true:

  • The author is known, and died before 1953
  • The author isn’t known, and the work was made before 1903

Unfortunately with my current information that would mean the work is still copyrighted for 2 years if it is unpublished, which seems likely. Can you provide any info to help with this? Thanks, Snowmanonahoe (talk) 14:20, 26 March 2023 (UTC)[reply]

Sorry, I immediately dismissed said friend request assuming it to be spam. The issue here is that it's not clear whether the work was published or not. If it wasn't, the work doesn't enter the PD until next year. Snowmanonahoe (talk) 15:11, 26 March 2023 (UTC)[reply]
The great grandson says it's a print passed down in the family and doesn't know if it was published, and the photographer isn't known (anonymous).
To be safe do you suggest taking it down and posting it next year when it's safely known as being in PD. Venomgwar (talk) 15:44, 26 March 2023 (UTC)[reply]
