There seems to be a problem regarding the description and/or licensing of this particular file. It has been found that you've added in the image's description only a Template that's not a license and although it provides useful information about the image, it's not a valid license. Could you please resolve this problem, adding the license in the image linked above? You can edit the description page and change the text. As fr as i Know, the photo wasn't added to commons by the author and, int eh flickr account, it clearly says that he has all the rights reserved http://www.flickr.com/photos/janblok/879416716/in/set-72157594437465976/ so the photo shouldn't be in commons ( neither the full or cropped version of it) --Totorobeckham (talk) 20:26, 26 June 2009 (UTC)[reply]
No, it wasn't uploaded by Commons by the Flickr user but that doesn't matter. The Flickr user released it under a free licence, they cannot later revoke that licence despite what statements they might make to that effect. Please do not continue to change these images. His permission isn't necessary since he released the image under a free licence. He cannot revoke that licence so any claim that this image is "all rights reserved" is invalid. We will rely on the evidence of this report by the "FlickreviewR" bot as being prima facie evidence that the image was at one time under a free licence on Flickr (and if it was under a free licence, then it doesn't matter who uploaded it). If you want to call the status of the image into question, then you really need to come up with better arguments and do things in a different way, because your current activities are going nowhere fast... If it was uploaded witout the permission of the author beign the photo with all its rights resverved, then, it shouldn't be available.
I'll put an example for you. Once I uploaded a photo of a magazine cover with Twiggy on it, to illustrate her article on wikipedia.
The photo was deleted (despite the magazine is actually mine, cos i bought it) due to copyright issues... why does this image deserves to be stil uploaded when the author hasn't authorized it and, clearly, on his fickr account, says that HE OWNS ALL THE RIGHTS to his image (as you can check by visiting his flickr account) and that he doesn't allow hisa work to be used in any comercial or non comercial way in any media?
Tell me what's the difference between a magazine from the 60's and a photo that was uploadedto flickr... does the magazine has copyright and the photo doesn't because it was uoloaded to flickr?

As I've explained above, since the photographer released it under a free licence, further permission to upload it here isn't required. The difference between your magazine cover and this photo is that this was released under a free licence by the photographer. Buying a magazine doesn't give you the rights to republish its content as you desire. The fact that the Flickr user now says he doesn't want his work to be used is irrelevant. THE PHOTOGRAPHER DIDN'T UPLOADED THE PHOTO it was someone else wihtout his permission. I've contacted him and this is what he said "Hell Jaime, Thanks a lot for telling me that my picture has been used in Wiki. I didn't know and I never gave poermission" and I can upload a screenshot if you want to. The photographer released the image under a free licence. When you do so, what you are saying is that anyone can use it providing they comply with the terms of the licence. They don't need further permission. The photographer released the image under a free licence and they cannot suddenly revoke that licence. This problem results from a fundamental flaw of Flickr. The site allows users to tag their image as being available under a certain licence but also allows them to change it back to "all rights reserved" when to do so doesn't comply with the terms of licence they agreed to. Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

Pay attention to copyright
Wikimedia Commons does not accept fair use content.

We do this because Commons is a shared media repository. Downstream wikis have different policies based on local laws. Uses that are acceptable under US law, for example, may not be acceptable in many other countries with more restrictive rules.

In addition, fair use is not compatible with our aim as a collection of freely distributable media files.

Therefore, Commons cannot legally rely on fair use provisions.

Non-free content that may be used with reference to fair use may be uploaded locally if your project allows this.

The image was given by cmg worldwide fot its free use and i've told to contact them for more information, because the info i send was said not to be enough to prove that the image was now copyright free.

La imagen fue proveìda por cmg worldwide para su libre uso y les he dicho que puedne contactarlos directamente para obtener mas informacion, ya que se dijo que la informaicón que yo proveí al respecto no era suficiente para probar que la imagen estaba ahora libre de copyright.
