Greetings: Thank you for your email, however, you seem to be missing the point of Commons - to hold freely licensed media. Commons cannot accept images you take from the web (from their real creators) and upload here, claimed as own work. You've done this even after being warned, noticed and posted, for example: Commons:Deletion requests/File:IMLE - Amhrán - Go deo, go deo.jpg which you uploaded after being told not to upload copyrighted materials. It's a record album cover, right? Why do you think it's free of copyright and ok for you to upload as own work? Please do not correspond about this by email; the response time is much slower and nothing you wrote was private so there is no reason to create the extra work. One thing you wrote was especially troubling "I just want to do my editing in Irish and I don't have time to inspect where the photos come from, in a subject I know next to nothing about! Pay attention to licensing
Wikimedia Commons only accepts free content: images and other media files that can be used by anyone, for any purpose.

File:Constitution of Ireland, Bunreacht na hEireann, 1937, government of Ireland.jpg seems to be free (or it would be proposed for deletion), but it was identified as having a wrong license. Usually, it is because a public domain image is tagged with a free license, or because the stated source or other information is not sufficient to prove the selected tag is correct. Please verify that you applied the correct license tag for this file.

The reason given by the user who added this tag is: Uploader suggests that this file is eligible for "cc-zero". And that the copyright owner (the Government of Ireland) has released this into the public domain waived all of their rights. I can see no evidence of this. And I note that the same file is used on the EN project (en:File:BunreachtHead.JPG) with a Fair Use claim. With a suggestion that this file represents the cover of a work that is copyrighted. Something's wrong somewhere...

Hi Guliolopez, would it be possible to explain to me what I should have done or what I should do? I don't understand at all how these images work. It would be constructive of you if you could explain or point me towards a * readable * document.
In this case, the image in question is part of the cover of a government publication from 1937, and the Constitution of a country as you can well see. (If I just typed out the words and upload an image of the words, an image that I create myself, is that OK ? And is there any special way that I need to do it or special form or declaration to make ?)

For English language Wikipedia, there is the possibility to put images in "Fair" mode and use them. For Irish Language Wikipedia, this possibility does not exist.

It is very frustrating to see many images in English language Wikipedia and unable to use them, for some reason totally unknown to me. As you doubtless know, my only interest is in Irish language pages and your assistance here would be much appreciated. I want to upload images to directly to Irish Wikipedia. This used to be possible and the right to do this was withdrawn around 2016/2017.
I did ask you for help on this back then. Once again, your constructive - and friendly - help would be appreciated, still. I knew there was a development underway to re-allow people to upload images to GA wikipedia, and is what I thought I was doing. You can dress up what you are doing with legal-this and legal-that ... but the end result has been that English language Wikipedia articles can choose from much better images than articles in the Irish language, and the divergence is increasing since 2017.
It is deeply ironic that even on topics related to the Irish language, English language articles often have much better images to choose from than in Gaelic. Obviously people writing in English are uploading images with "Fair" as this is just easier than bothering with the legalese that I, and I presume many others, don't understand.
I would hope that somebody in your position, with your experience, could explain to me in simple - and friendly - and unaggressive - terms how to put matters right, if this is possible. Thanks. TGcoa (talk) 21:49, 9 March 2021 (UTC)[reply]

Yes. There is. If there is a valid reason for uploading a 'fair use' image, then you could:
* Use the GA Wikipedia form for uploading images. Which is here
* Apply the correct 'fair use' licence tag. Which are here
* Add and complete the 'fair use rationale" tag. Which is here
(If you are unclear on what the end-result should look like, you can find examples like these in the relevant "Íomhánna nach bhfuil saor" category.)
(Update) It seems that (at some point) the rights to upload and reupload files were restricted to a small set of users. I'll see whether/what can be done about that.
RE: "I don't understand at all how these images work"
Ideally you would familiarise yourself with the Wikipedia "non-free use rationale guideline". Including the related criteria. In short, we can only claim that an image is "fair use" under certain criteria. Like a book cover being used to illustrate an article about that book. Or an otherwise copyrighted logo used in article about the related brand or company. In each case where no non-free version is available or could be created. Using, for example, the cover of a published/copyrighted work purely to "illustrate" or "decorate" an unrelated article doesn't fall within the criteria.
Separately, while I and others are happy to help, the burden (rightly or wrongly) lies with the content contributor. I don't know why the "old" upload button was removed. But I would suspect it was because it was seeing more misuse than valid use. Unreasonably shifting the burden (which should lie with the content contributors) to a small number of administrators. On that project. Certainly I struggled to ensure the project didn't become a target for copyright violators. Well meaning or otherwise.
