The picture was from Government of Nigeria and I agree that it was "your" picture because you edited it by adding something below the photo, however the source photo is ultimately not from you. MarioJump83! 07:22, 15 January 2021 (UTC)[reply]

This person is a public figure and government official. The picture i used is the new official portrait for his new office he was deployed to. I think you should try to find free pictures of Gabriel Aduda online (the ones that is released CC), rather than the one from Government of Nigeria itself. Or... you could try to find one and upload it to the Wikipedia only rather than Wikimedia Commons? MarioJump83! 02:39, 17 January 2021 (UTC)[reply]

You guys are really confusing me with all these copyright issue about this picture. Your statement says i should find a free picture online, but if i do you will still flag it for breaking your copyright rules. I cited the reliable source where the picture was lifted from. This picture is in public domain, it was released by the ministry he is deployed to. This is his new official portrait, Which means everyone can use for publications. He is a public servant and Permanent Secretary to the government. He is not a private individual.

If i just go ahead to pick any picture online to use, won't it be flagged copyright again? Moreover, there is no good portrait online i can use, most of them are old and unclear images. Please if you see any photo that is good enough and meets all your copyright rules, please kindly help me upload it. Thanks

The portrait by Mr. Buhari that was uploaded to the Commons has the permission by the author of the photo and was approved by the Wikimedia OTRS team. Meanwhile, the photo of Gabriel Aduda is certainly does not have the same author as the Buhari did, thus is not eligible to be hosted by Wikimedia Commons.

In Nigeria, notice there is no exception for government works – quite the opposite, they are very broadly covered: " Copyright shall be conferred by this section on every work, which is eligible for copyright and is made by or under the direction or control of the Government, a State authority or prescribed international body." Based on your statements, you believed that these works are released to the public domain by the author of the work. If you believe that you have the permission by Foreign Ministry or the author of the photo to do so, then you will need a proof which would be sent to the Wikimedia OTRS team. From COM:OTRS:

I have received permission from the original author (not me) to upload the file to Commons.

Please ask the copyright holder to send a permission statement to the address listed above. We require that owners make a clear statement that they release the image under a free license; to help prevent confusion or misunderstandings we prefer one of the email templates be used. Permission grants must specifically contain a free license grant and may not merely give permissions for Commons or Wikipedia. If you have already uploaded the image to Commons, follow the instructions on Template:OTRS pending.

You ignored the part where i asked you to kindly help me look for a suitable picture online that won't violate the copyright rule and upload it to the article.
