Researched this and think I see why this was seen as a possible problem. Is this is an infringement issue regarding photos of sculptures (a Fair Use question)?
This may be relevant:
"The fair use exception to the copyright law allows for use of a photograph of an artwork for educational, critical, scholarly, satirical, or newsworthy purposes—protecting schools and publications from infringement claims, for instance—and also requires a degree of 'economic injury' to the copyright holder."(http://www.sculpture.org/documents/scmag05/may_05/webspecs/grant.shtml)
As well as this (from http://photosecrets.com/can-i-use-this-photo), which is an excerpt of the applicable law as quoted there, 17 U.S.C. § 107:
Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
- 1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
- 2. the nature of the copyrighted work;
- 3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
- 4. the effect of the use upon the potential market for or value of the copyrighted work.
Regarding 1: Both the park where the sculptures are and WikiMedia are "nonprofit & educational" in nature, so I do not see a problem.
Regarding 3: Only one view is shown of each sculpture so the "amount and substantiality" is small.
Regarding 4: No one seeing a photo of a sculpture who could buy a copy of the sculpture will be dissuaded from such a purchase due to the image in a photo.
And by the way: File:A resident peacock 6-22-2014.jpg is a photo of an actual wild animal! Rp2006 (talk) 20:39, 11 October 2016 (UTC)
