Re: Permissions questions sent by MarchJuly. Thanks for this alert. I've been reading various tutorials and now have a firm grasp on what the problem is. My only remaining quandary is how to convey permissions from the artist whose works are depicted here and how to denote is explicit wishes concerning them. Please be aware that this is in process and, if these images must be deleted, please feel free to do so and I will take it from the top and do it right this time.

I'm new at this and think that I may be talking to myself by writing here -- rather what I want, which is to actually respond to these alerts. Time will tell. Thanks.

Hi Rmark1030 and I apologize for not noticing this post sooner. Only images which are freely licensed can be uploaded to Commons. One way to determine whether image can be freely licensed is to verify its copyright status. Not typically, but sometimes a website, etc. will explicitly say that content posted on the site are freely licensed and can be re-used without restrictions. In such cases, simply providing a link showing to show that the image can be licensed as free is sufficient for proper verification. In most cases, however, things are not so clear.
Much of the content on third-party websites, in photographs or scans, etc., however, is protected by copyright so such content cannot be uploaded to Commons without providing proof that the original copyright holder has given permission to do so. The original copyright holder must notify Commons via the OTRS process (See COM:OTRS#If you are not the copyright holder) and formally declare that they consent to the free license. Even in cases where content has been uploaded to Commons by the original copyright holder themselves, a declaration of consent still may need to be formally submitted (See COM:OTRS#Licensing images: when do I contact OTRS?) for verification purposes. Even if the copyright holder gives you permission to use upload the image, they still have to formally give everybody and anybody the same permission to use the image now or in the future without any strings attached.
This may seem like unnecessary red tape at first, but try and remember that, as with Wikipedia, pretty much anyone can create a Commons account and claim to be someone else. There's simply no way to really tell if some is who they say there from their username. Anyone can also claim they were given permission to use the image, but again this is almost impossible to verify. By agreeing to a "free license", the copyright holder essentially is saying that anyone anywhere can use the content in anyway they like for pretty much forever. This includes altering image in anyway or using it for commercial reasons. This why more formal verification is often required when content is claimed as "own work" and images lacking that permission are typically deleted. This may seem a bit extreme, but it's done to not only protect the Wikimedia Commons, but also the interests of copyright holders. - Marchjuly (talk) 06:41, 13 August 2015 (UTC)[reply]
Hi. Seriously, I'm completely sympathetic with the concerns you've expressed. Further to that, I went to the artist himself, discussed the implications of a share alike license with him and encouraged him to send images that he feels comfortable sharing directly from his own Wikimedia account on his own computer. At this moment, he, his wife and I are trying to meet the standard of authentication required. (Wikimedia documentation on this subject is FAR worse to parse than HiFi system setup documentation from 1962) We are working on it and would love some feedback. At present, we are guessing that if Alberto responds from his own computer, via the email account he used to establish a Wikimedia Commons account in the first place -- this may be sufficient. I hope so.

I think I understand the situation a little better now Rmark1030. Unfortunately, I do not think that simply responding from "his" own computer and using "his" own email address and "his" own Wikimedia Commons account is going to be sufficient, simply because there is no real way to verify from that information that he is who he claims to be. What Mr. Gomez or someone associated with him needs to do is carefully read the instructions in COM:OTRS#Licensing images: when do I contact OTRS? and send a COM:OTRS#Declaration of consent for all enquiries to the email address listed. The example "declaration of consent" listed on that page should be used and all of the necessary information should be provided. Make sure that the instructions are followed to avoid any problems. An OTRS volunteer will examine the email and determine whether it is OK to upload the images to Commons. If you have any specific questions about OTRS procedures, then feel free to ask them at Commons:OTRS/Noticeboard. Marchjuly, couldn't you kindly just tell me what you WILL accept. In that this article and its associated images constitute some kind of fraud. It's not really a matter of what any particular editor will accept, it's a matter of whether the licensing of the images are acceptable per Wikimedia Commons policy. I'm pretty sure that all that needs to be done is for Mr. Gomez to send the aforementioned "declaration of consent" to OTRS. Just for reference, any editor may question the licensing of an image upltothe aded to Commons and tag it for discussion or deletion, but only certain editors such as administrators or OTRS volunteers can actually delete an image. Even if an administrator or OTRS volunteer decides that an image should be deleted, it's not really gone forever because it can always be restored (again by an OTRS volunteer or an administrator) if the problem with the licensing is resolved at a later date. FWIW, the best way to avoid images being tagged as problematic is to be patient and take the time to read though the relevant policy/guidelines to make sure the licensing is all sorted out before uploading the image. As you mentioned, things can be a bit confusing at first, so there really should be no great rush to upload something whose permission status is unclear and which is only going to have to be sorted out by someone else after the fact. - Marchjuly (talk) 04:39, 14 August 2015 (UTC)[reply]

No worries. Nobody expects you any editor to immediately be aware of every policy or guideline the minute they login for the first time. Mistakes are expected, not only from new editors, but also from experienced editors. Commons may seem to be a bit harsher and quicker to the draw than Wikipedia, but that's probably due to the fact that most of the problems dealt with here relate to copyrights and licensing: two areas where there is not a lot of wiggle room. As I said above, any image that is deleted for "lack of permission", etc. can always be requested to be restored at a later date once the problem has been resolved. One thing that sometimes help is to ask questions at COM:VPC about an image and how it should be licensed before uploading it. The editors hanging out there are usually very experienced in such matters and are more than happy to answer any questions about such things. - Marchjuly (talk) 06:13, 14 August 2015 (UTC)[reply]
PS: If Mr. Gomez plans on sending an email to OTRS stating that he agrees to license his work freely, then he should just use one of the email templates at Commons:Email templates/Consent. He can even send it in language other than English if he prefers. Once he sends the email, he or you can remove the Template:No permission since I added and replace it with a Template:OTRSPending. This means he will be given at least 15 to 30 days for OTRS to receive and verify his email, before the image is marked once again as "no permission since". Please note that the "OTRSPending" should only be used for images already uploaded and when a "permissions" email has been sent to OTRS after the fact.
