Did I understand correct that you are telling that you are going to delete my own illustrations? And that you claim that I do not have copyright to my own work..? :o

They are my very own works, that I did by readers' requests especially to describe the emergency communications system. Now you threaten to delete them..? I have clearly stated my ownership and copyright to them. In any country, written copyright marking is official and lawful. What does that message about deleting them mean?

I got also curious messages asking me to sign my messages. As you and anyone able to read can see, I have signed them clearly with my own name, as well as with my unique international radio amateur callsign:

Dear Sir,

You have deleted the drawing my friend Matti Pyykkonen kindly made with effort to describe readers emergency comms message handling.

There was nothing wrong with rights to publish it. Why did you delete it? I clearly wrote on it about permission and linked it to his page! Did you ever read it? I have been writing, illustrating and and co-authoring printed media for decades and I am quite familiar with the rules of crediting pics for their copyright owners.

We can not get the pic back after your deletion. Neither me or Matti himself managed to restore it. Hitting help buttons all we get is page after page of incomprehensible computer code! So I kindly ask you to put the pic back, please!

Juha,
Kuten mainitsin poistokeskustelussa, Matin tulee lähettää kuvasta OTRS-lupa. Se on keino jolla Commons pitää kirjaa tekijänoikeusluvista jos kuvan tekijä ja tallettanut käyttäjä ovat eri henkilöitä.
Kuvan palauttamista voi pyytää Commons:Undeletion requests-sivulta.
Minä ehdotin kuvaa poistettavaksi, mutta lopullisen poiston teki User:INeverCry. Minulla itselläni ei ole oikeuksia kuvien poistoon tai poistettujen palauttamiseen. Hyvä MKFI,

En tiedä mikä on OTRS-lupa, enkä miten tai mistä sitä haetaan. Tiedän kyllä mikä on copyright eli tekijänoikeus. Se on universaali oikeus, joka Matilla on omaan kuvaansa. Kuvateksti on varustettu linkillä hänen alkuperäissivuilleen. Samoin minulla on tekijänoikeus omiin kuviini, joita laitoin samalle sivulle. Silti kummastakin tuli ylläpidolta huomautuksia!

Kaikki nämä kuvat olemme tehneet lukijoiden pyynnöstä vartavasten havainnollistamaan sivun kuvaamaa viestijärjestelmää. Nyt onkin aika vaikea selittää ihmetteleville lukijoille, miksi kuva on poistettu, eikä sitä saa takaisin: "Wikin ylläpidossa joku tuntematon nimimerkki poisti sen. Hän väitti, ettei meillä ole itse tekemiimme kuviin tekijänoikeutta".

Kun kuvaan on selväkielisesti kirjoittaen on merkitty luonnollisen henkilön tekijänoikeus, niin merkintä on pitävä. Tällainen selvästi tekijänoikeusmerkittyjen kuvien poisto ja jonkin käsittämättömän tietokonekoodin kirjoittamisen vaatimus vaikuttaa paremminkin kiusanteolta, kuin ylläpidolta...

Jos nyt kysyisin tuota kuvan poiston suorittanutta ylläpitokaveriasi sen palauttamaan, hän arvatenkin vastaisi, ettei voi palauttaa, koska sinä pyysit poistamaan kuvan. Olisiko toimivampaa, että sinä pyytäisit häntä myös palauttamaan kuvan? Voinko pyytää tällaista palvelusta?

Tässä vielä linkki OTRS-ohjeisiin: Commons:OTRS. Lupa on Matin OTRS-sähköpostiin (permissions-commons@wikimedia.org) lähettämä viesti jossa hän vakuuttaa suostuvansa julkaisemaan kuvan vapaalla lisenssillä (lisenssi pitää mainita erikseen). Tarkoitus ei ole kiusata ihmisiä; tekijänoikeuslakeja ei ole aivan ajateltu Wikipedian kaltaiseen yhteisöön ja vapaiden lisenssien käyttöön ja siksi sen sovittaminen tekijänoikeuslakien vanhoihin pykäliin on joskus työlästä.
Kuitenkin: "selväkielisesti kirjoittaen on merkitty luonnollisen henkilön tekijänoikeus" ei riitä jos kuvan on tehnyt joku muu. Kuka tahansa voisi helposti lisätä sellaisen kuvan tietoihin oli hänellä oikeus siihen tai ei. Ongelma on seuraava tilanne, joka on tullut vastaan aiemmin muiden Commonsin kuvien kanssa:
1. Wikimedia Commonsiin tallennettu kuva ei ole pelkästään tallennettu käyttöä varten, vaan se on nimenomaisesti julkaistu maailmanlaajuisella, kenen tahansa vapaasti käytettävissä olevalla lisenssillä joka pysyvä ja peruuttamaton. "Kuka tahansa" tarkoittaa aivan ketä tahansa, myös kaupallisia tarkoituksia Wikipedian ulkopuolella.
2. Joku ottaa kuvan ja julkaisee sen edelleen (lisenssiehtojen mukaan) kaupallisessa oppikirjassa tai vastaavassa.
3. Kuvan alkuperäinen omistaja älähtää ettei hän antanut lupaa kuvan käyttöön kaupallisesti.
Tämän tilanteen estämiseksi OTRS-lupamenettely on tehty. Ilman lupaa en usko että kuvaa palautetaan vaikka minä sitä pyytäisin; enhän minä tunne Mattia enkä pysty antamaan hänen puolestaan lupaa asiaan. Jos taas mainitsen pyynnön syyksi että sinä olet vakuuttanut olevasi siihen valtuutettu niin päädytään samaan syyhyn miksi kuva poistettiin: meillä ei ole vahvistusta Matilta.
Ja vielä lisäys kuvasta File:2016-06-13-2135 - Alinco APRS-igatena - Soundmodem softana - Aerialin kaksikkodipoli antennina Pielisellä (c) OH7HJ.jpg. Käyttäjä User:EugeneZelenko on merkinnyt siitä puuttuvan tekijänoikeustietoja. Luulen (kannattaa kysyä häneltä itseltään) että ongelmana on kuvassa oleva kuvankaappaus tietokoneohjelmasta ja siinä näkyvä kartta. Tietokoneohjelmien kuvankaappauksien tekijänoikeudet säilyvät osaltaan ohjelman tekijöillä (tai kartan tekijöillä) ja niiden tallettaminen on siksi yleisesti kiellettyä: Commons:Screenshots. Viestien allekirjoittamisesta vielä erikseen: automaattinen allekirjoitus tehdään neljällä aaltomerkillä: ~~~~. Se luo linkin käyttäjätiliisi. Kuten kerroin, enempää minä, kuin Matti itsekään emme saaneet kuvaa palautettua.

Matti yritti laittaa kuvan sivulle henkilökohtaisesti, omalla nimellään ja tekijänoikeudellaan.

Kuvaan on sekä lupa, että tekijänoikeus. Voisitko siis ystävällisesti palauttaa kuvan? Tai pyytää ylläpitäjää, jota pyysit poistamaan sen, palauttamaan kuvan takaisin..?

Toistan kuitenkin yhä edelleen saman asian: jos Matti Pyykkönen lähettää yhden sähköpostin niin asia luultavammin hoituu. Dear Sir,

You are threatening to delete the drawing my friend Matti Pyykkonen kindly made with effort to describe readers emergency comms message handling.

There is nothing wrong with rights to publish it. Why do you want to delete it? I have clearly writte on it about permission and linked it to Matti's page! Did you ever read the text about permission?

I have been writing and illustrating printed articles and and co-authoring books for decades so I am quite familiar with the rules of crediting pics for their copyright owners.
