Philippine photos

Hi, I notice that you claim that photos from the Philippine Institute of Volcanology are created by the government of the Philippines. Their web page claim "Copyright © 2004 Philippine Institute of Volcanology & Seismology . All Rights Reserved.". I believe that there is a legal distinction between the Philippine cabinet and other organizations in the Philippine society, and that these photos are not in fact public domain? Hi, PHIVOLCS is part of the Department of Science and Technology (DOST), which is in the executive branche of the Philippine government. (See also this page: [[3]]). All websites of the Philippine government can be identified by the extension .gov.ph As you can see this is the case with PHIVOLCS. The situation is very simular to that of its American counterpart US Geological Survey. (As are many things in Philippine society, as it was an American colony for about 50 years. You need pre-approval to publish photos by the Philippine government: From the Republic Act 8293 ([4]), section 176:

"No copyright shall subsist in any work of the Government of the Philippines. However, prior approval of the government agency or office wherein the work is created shall be necessary for exploitation of such work for profit. Such agency or office may, among other things, impose as a condition the payment of royalties. No prior approval or conditions shall be required for the use for any purpose of statutes, rules and regulations, and speeches, lectures, sermons, addresses, and dissertations, pronounced, read or rendered in courts of justice, before administrative agencies, in deliberative assemblies and in meetings of public character. (Sec. 9, first par., P.D. No. 49)

I see that you uploaded the subject image.

I noticed today while looking at [5] that this image appears to need updating. The image shows Palawan and its associated islands as being associated with the Northern Philippines (Regions 1-5). Palawan used to be Region 4b, but was transferred to region 6 on 23 May 2005 by Executive order No. 429. Accordingly, Palawan and its associated islands should be shown in the Tan color used for the Visayas rather the yellowish color used for the Northern Philippines.

Could you make this change or let me know of a reason why the change should not be made? Would it be better to leave this now-outdated image in place in case some pages need the current (now outdated) version and create a new updated version? I imagine that most pages using this image would be better served by an image showing current information.

I can photoshop the change myself if need be, but you probably have source files for this image which are not in .png format.

(followup) Subsequent to the above, I've become aware of AO129, which holds implementation of EO429 in abeyance. It seems that this image is still correct, for the moment. Various other images are out of sync - showing things as if EO429 were implemented. I've modified wikipedia articles on Palawan, Visayas, and MIMAROPA to show the current state of affairs (except for some out-of-sync images there). As of now, the Western Visayas article is still out-of-sync. Considering the foregoing, I don't think there is a need for image updates at this time. Cheers. -- Wtmitchell 01:02, 20 May 2007 (UTC)

Please help replace this outdated license

I am pretty sure that this was indeed a free image. In those days there was no such thing as a check by a moderator (as is done now for images from flickr, for example). Unfortunately I cannot check whether the license was indeed free, because the source website seems to be gone. Magalhães (talk) 05:09, 4 July 2010 (UTC)

Here is what the site looked like around the time the file was uploaded here. The photos are described as "royalty free" only. This is not equivalent to {{Copyrighted free use}}; in particular, there is no explicit permission to publish modified versions of the works. Furthermore, there is a stated requirement to credit the photographer, which is also required by law, and which has not been respected. —LX (talk, contribs) 08:45, 4 July 2010 (UTC)

I see some general remarks of the hosting website. There are nog specific remarks from the uploader of this picture, perhaps he/she mentioned specifically that it was PD, or something. I just do not remember anymore. Just delete it whenever is is problamatic. On the other hand, the pictures are already on commons for a couple of years.
