You wrote in your e-mail:
these photographs were both given to me for use by Joe Sorge and I have documentation of this as necessary. To the best of my knowledge, they belong to Joe and were either taken by him or for him.
Well then, the correct process is described at COM:OTRS. I notice that James Conway is a professional photographer. For File:Joeavatar.jpg, you would thus need to
  • show that Joe gave you permission to publish the image under a free license, and
  • show that James Conway licensed the image to Joe in a way that allows Joe to do so (or that James Conway transferred copyrights to Joe), and
  • clarify whether that release applied only tothe small version you uploaded, or to larger versions found elsewhere, too.
Note that a free license allows anyone to use the image for any legal purpose, including commercial purposes.
For File:Ajbforwiki.jpg, the situation is similar:
  • show that Joe owns the rights (which would need explaining why the Flickr user didn't have the rights),
  • show that you have permission to freely license the image, and
  • clarify whether the license applied only to the small version or also to other versions.
All this via e-mail to our OTRS e-mail address, and best coming from an official e-mail address of the AJ Bombers (i.e., one ending in @ajbombers.com).

Fair enough, I've let Mr. Sorge know. In the mean time could you please not delete them for a few days while we get this sorted out? I have copy/pasted your instructions to him so he'll know.


Okay. These are now in Joe's Flikr account and he says he believes they should be under creative commons. Links:

Let's see:

  1. CC-BY-NC is a non-commercial license unsuitable for the Commons. From the CC licenses, only CC-BY and CC-BY-SA are acceptable here. anything with NC or ND in it isn't OK at the Commons.
  2. Uploading File:Ajbforwiki.jpg to http://www.flickr.com/photos/ajbombers/5118940292 doesn't change anything. Please provide evidence (via e-mail from @ajbombers.com to our OTRS address permissions-commons@wikimedia.org) that AJ Bombers is the rights owner on that image, and explain why it's not Ben Bryan who owns the rights. I notice that Ben Bryan has other photos with this kind of photoshop effect in his photostream, and that his photo of the sign in 1024×1024px large...
  3. File:Joeavatar.jpg indeed exists at Flickr since April 17, 2010. Still, it's licensed CC-BY-NC, and was taken with a professional camera, a Canon EOS 5D Mark II, which is a far cry from the Palm pre, iPhone, or even the Canon EOS 30D I see on other photos in that photostream. So I think the photographer really was James Conway as stated at [1], and you'd still need to provide evidence that Conway granted Joe enough rights so that Joe can decide to freely license the image.
  4. File:AJBartender.jpg is at Flickr, too. Since it doesn't appear to be published anywhere else, we'll assume that AJ Bombers owns the rights to this image. However, it's licensed CC-BY-NC again.
  5. Don't worry about files getting deleted here; when all this is sorted out, we can always restore them.

To clarify: There are two ways to make the license (at least for File:AJBartender.jpg; the other two images have other problems besides their licensing at Flickr) Commons-compatible: either change the license at Flickr to CC-BY or CC-BY-SA, or grant a CC-BY or CC-BY-SA license via e-mail (as described above) to our OTRS team. Tip: Add categories to your files
Tip: Add categories to your files

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").
