your assistance please...
[edit]You deleted File:Brett Sullivan.jpg, as a copyright violation.
There is a version, apparently properly licensed file, with the same name, on en.wiki. I was going to port it to the commons -- that is how I found commons once had a file of that name.
Could you compare the en.wiki image with the image you deleted, and confirm or refute whether they are the same?
Thanks! Geo Swan (talk) 04:13, 9 January 2019 (UTC)

File:Keven McDonald Basketball Action Photo.jpg This is MY PHOTO!
[edit]Hello Mr. Howes,
My name is Keven McDonald and I am the subject, but not the creator, of the page in question. Over the last several days I've been trying to improve the page by removing the inaccuracies, misspellings and incorrect historical information. I've also included some additional information about my accomplishments that were omitted by the original author. Yesterday I finally got the page to the point where that phase of my life is accurately portrayed. Finally, I dug up an old photo taken of me years ago by a relative, took a picture of it on my phone and uploaded it to my page. The page looked great! I noticed today that the picture was removed by you. Since you nor anyone else gave me specific reason I must ask you why? Please be specific. I understand the need for the "Wiki police" to maintain the integrity of Wikipedia. I get it. But where were these people when the creator of the site misrepresented so many aspects of my life? Where were the "police" then? By contrast, all I did was put my own photo on a page about me and you deleted it without a specific reason.
Please allow me to put my picture on my page. If I missed a procedural step when I uploaded the picture please let me know. Also, if you need me to give you some identification to prove I am Keven McDonald I'll be happy to do it. Otherwise, please put my picture back. This is absurd.
Keven McDonald (12:13, 16 June 2019)
- Because the Wikimedia Foundation strongly respects creators' copyrights, File:Keven McDonald Basketball Action Photo.jpg was deleted as a Copyright violation. Under United States copyright law, the copyright holder of a photograph is normally the person who took the photograph, rather than a person who appears in a photograph, unless the copyright is transferred by operation of law or written contract.
- In order for us to accept this photo, can you please have the photographer email the following free license permission to permissions-commons@wikimedia.org, referencing the deleted filename:
I hereby affirm that I, _______________, represent Penn Athletics, the creator and/or sole owner of the exclusive copyright of the media work Keven McDonald Basketball Action Photo.jpg.

- Mr. Howes,
- I just completed the "undelete" process and will explain to you what I explained in that process. This photo was taken by a relative of mine, my Uncle Jimmy, more than 40 years ago. At some point during my playing days at Penn I needed a photo for various basketball related events. I let Penn use the photo for these events. Over the years this photo has been used countless times by people and entities that I know and countless who I don't know. Neither I nor my Uncle Jimmy (long dead now) ever objected to the use of my photo, particularly when there was no commercial intent behind the use of the picture. This is the first and only time I've had a problem using my own picture, taken by and given to me by my Uncle. My uncle died in 2006 so he obviously can't fill out the form above. However, since he gave me the picture it BELONGS TO ME. As such, there is no copyright infringement. I give you, Wikipedia, Commons and whoever else full rights and permissions and relieve you of any legal obligations. All I want is my damn picture on a page about me...a picture that is directly relevant to the subject matter of the page, basketball!! With respect, I've spent more time explaining this picture today than I've spent in the last 40 plus years! As I mentioned in my last communication, I understand you have a job to do. But this is my picture. It belongs to ME. I don't care that it's all over the internet. I don't care that others have used it. I have never had a problem with that. The irony here is that countless others have used this picture for one reason or another with my permission. Yet now I want to use my own picture on my wiki page and I'm denied.
- Please undelete MY picture and place it in the upper left corner of the page with the same caption I created. No one but myself can raise a copyright issue and I promise I won't! I've already spent more time with this than it warrants.
- Thank you, please put my picture back.
- For the record, below is the completed form above:
- I hereby affirm that I, Keven McDonald, am the creator and/or sole owner of the exclusive copyright of the media work attached to this eMail.
- I agree to publish the above-mentioned work under the Creative Commons Attribution-ShareAlike 4.0 International.
- I acknowledge that by doing so I grant anyone the right to use the work, even in a commercial product or otherwise, and to modify it according to their needs, provided that they abide by the terms of the license and any other applicable laws.

- I am aware that the copyright holder always retains ownership of the copyright as well as the right to be attributed in accordance with the license chosen. Modifications others make to the work will not be claimed to have been made by the copyright holder.
- I acknowledge that I cannot withdraw this agreement, and that the content may or may not be kept permanently on a Wikimedia project.

To keep the discussion in one place, I've responded at Undeletion Requests. JGHowes talk 19:34, 16 June 2019 (UTC)
Mr. Howes,
I've just finished speaking with an official in the Penn Athletic Department. She sees no immediate problem with Penn allowing me to use my photo. My question is whether I need to send them the form above or is there some other form that is more appropriate since permission is coming from a department rather than an individual. I ask this question in an effort to avoid any more unnecessary delay in this matter. Please confirm that the instructions above are what I need to send Penn or if they need to be modified for a department. I've told them they need to respond on official Athletic Dept. email letterhead. Any other required instructions for the department, if necessary, would be helpful here. I await your reply.
Thank you,
Keven McDonald
- Keven, the answer depends on whether: (a) Penn claims copyright ownership; or (b) your late uncle was the copyright owner at the time of his death and Penn does not claim to be the copyright holder. If it's (a), then yes, Penn needs to email us their signed Creative Commons Attribution-ShareAlike 4.0 license highlighted above in blue, signed by a Penn official as authorized agent for the University. If (b), on the other hand, a simple email from Penn to that effect will suffice.
- In either case, the email should be on official letterhead sent to permissions-commons@wikimedia.org — this is our confidential email system (called "OTRS") to which only a few volunteers such as myself have access.
- I realize this may all be very frustrating, but copyright of photos has detailed laws we must follow.
- Hope this helps, JGHowes talk 15:56, 17 June 2019 (UTC)
- Mr. Howes,
- I appreciate the prompt reply. My only concern is that the form speaks in the first person. Obviously the Penn Athletic Dept. is not an individual so I ask again, does the form need to be modified in any way to reflect that? If not, I'll send it as is. If so, please instruct me on the proper modifications, if any.
- Thank you,
- See modified release form, above. JGHowes talk 16:46, 17 June 2019 (UTC)

Hello,
You are mentioned as the contact concerning this image. I uploaded it on wikimedia commons. It was provided to me by the subject in the image, Mr. Caslen, and I forwarded his permission by email. Because that was not sufficient, Mr. Caslen in the meantime sent a release email. We hope it now abides by wiki guidelines. - As you were informed by User:Secondarywaltz, only the copyright holder can license a photo for Wikimedia Commons. Under the copyright law of most countries, the copyright of a photograph actually belongs to the photographer, not a person appearing in the photo, unless transferred by contract or terms of employment. Thus, the permission for this photo must come from the photographer, not Gen. Caslen, and he has been so informed. (ref: OTRS ticket #2019072710000197) JGHowes talk 18:39, 27 July 2019 (UTC)

Hi, sorry to bother you, I'd like to know what happened to this file that you deleted. I think it was deleted by mistake. The file I uploaded was a screenshot properly licensed in YouTube under a CC license. —Frodar (talk) 05:56, 10 August 2019 (UTC)
- Frodar, I'll be happy to take another look at it. License Review didn't confirm that it has a free license acceptable at Wikimedia Commons. Some CC licenses are unacceptable, such as cc-by-nc-3.0 and others that have restrictive "nc" (Noncommercial) and "nd" (No Derivatives) licenses. We only accept "sa" (Share Alike) ones that allow commercial and derivative uses. Kindly point out where this YouTube video explicitly state it is released under a cc-by-sa-3.0 license? JGHowes talk 12:36, 10 August 2019 (UTC)
- This is the video. Is licensed under the Attribution 3.0 Unported (CC BY 3.0) license. Yes, there's no "SA", because YouTube doesn't offer to mark their videos as "SA", the CC license YouTube offers it's even less restrictive than a Share Alike, it is a Just Attribution license. Also, Commons:YouTube files says nothing about requiring a Share Alike license, and it's comparable to the Flickr CC-BY marked files, that are OK here in Commons.—Frodar (talk) 16:58, 10 August 2019 (UTC)

Restore File:Indradhanu Founders.jpg
[edit]Sir, The File File:Indradhanu Founders.jpg depicts the founders of the club I work for. By the time I joined Indradhanu the founders were long retired and their status is unknown, so is the person who took the picture. As the part of the team who manages the Club's online presence I request you to undelete the file or kindly tell me what I need to do to restore the file.Aadarshashutosh (talk) 16:35, 25 August 2019 (UTC)
- I am sorry, Aadarshashutosh, but Wikimedia Commons strictly observes copyright law, as a repository of free images available for anyone to use worldwide, including commercial uses. We only accept images already in the Public Domain or expressly licensed by the copyright owner. Under US law, the copyright owner is generally the photographer who took the picture. The only exception would be a photo taken by an employee as "work for hire" where the copyright owner is the employer. So if the photographer is unknown, we can't accept it until copyright expires 95 years after first published. You could make an undeletion request with your reason(s), but I doubt it would be successful. JGHowes talk 19:36, 25 August 2019 (UTC)

- Dear Mr. Vermeir, The photo was deleted as a possible copyright violation because: (1) it has previously appeared elsewhere on copyrighted websites; and (2) under US and EU copyright law, a photograph's copyright is owned by the photographer, not a person depicted in the photo (unless transferred by contract or done by an employee as a "work for hire").

This is Kylejinx. I created the XCORPIIIO article. I would like for you to return the headshot photo of the entity known as XCORPIIIO back to the top of the page, where it was. There is no copyright infringement, as I myself took the picture. It is my property, and I have already taken the proper steps in confirming that I have the rights to upload all of the photos on that page. Please place it back as soon as possible. Thank you for your cooperation in this matter.

[edit]Hello: Thank you for notifying me that my photograph was used for the latest issue of Radio World. I have always been happy with that particular picture. I only regret not taking any interest in the transmitter towers at the time, given that they came down soon afterwards. They were an epic setup. In taking a quick look at the article - I realize there is an error. The building in the foreground still exists, in mothballs, while the towers in the background are gone. Would you kindly let the authors know this? Here is a link to a recent article about the sites present status. Verne Equinox (talk) 02:33, 13 October 2019 (UTC)
- I've made that correction and added the recent article link. The Radio World article captioned the photo, "...now demolished", which led to that conclusion. As a teenager, I used to listen to shortwave a lot, and the three strongest stations back then were invariably Radio Canada, BBC, and Radio Moscow. JGHowes talk 03:29, 13 October 2019 (UTC)
Unresolved issue regarding attribution of watercolor to William Henry Hunt
[edit]Dear Mr. Howes,
You suggested a resolution regarding the attribution of a watercolor to the English artist, William Henry Hunt, in connection with a dispute which began in September and which invoved almost 2 weeks of extensive discussion. COM:Help_desk/Archive/2019/08#Deletion_request_based_on_image_of_a_painting_that_is_a_forgery JGHowes talk 18:11, 14 October 2019 (UTC)
After you suggested on September 10 that, among other things, the words "attributed to" before the artist's name, which was, in substance, how I had initially edited the file. Since three weeks had passed with what appeared to me to be no further actvity, I enquired of you on October 2 how your suggestion was to be put into effect. I noted that "to my knowledge, no one has filed an objection" to your proposed resolution. When I received no response to my Oct. 2 enquiry, I went ahead on October 8 and edited the identity of the artist to match precisely what you had proposed as a resolution.
On October 17, the person who had posted the image responded to my October 2 question with a one word assertion "False." This wa patently frivolous, since he could not have possibly known if I had knowledge of any objection, and, to this date, I am unaware of any objection or appeal of any sort. On the same date he reverted my edt so that the artist listed for the file was precisely as it was when I first questioned the attribution.
While I freely admit that I have no expertise on Wikimedia Commons procedures, I have gone to great lengths to establish my expertise on the art of William Henry Hunt. The person who posted the file seems to have exactly the opposite expertise, having admitted that he knows absolutely nothing about William Henry Hunt. Since he clearly is very involved with Wikimedia Commons, one would think that he would, at the very least, be cognizant of how his actions, including what appears to be gamesmanship motivated by nothing but ego and his constant disparagement of someone who has no stake in any of this other than factual accuracy on a subject of great academic interest to him, reflects very poorly on yhe integrity of Wikimedia Commons. At this point I see no way to have an actual, binding determination on this issue, and I feel that it has been nothing but a big waste of time to have ever gotten involved with what should be a straightforward issue. No one could seriously claim that there is any consensus regarding the attribution of the artist for his painting -- certainly no basis for Wikimedia to allow an unchallenged statement that the paining is by Hunt.
If this file cannot be edited along the lines you suggested, I want a formal dispute resolution procedure to be instituted which will allow both parties to this dispute to defend in a comprehensive and orderly manner their positions. I also would appreciate it if you could inform me exactly how Mr. Mabbett objected/appealed your proposed resolution and where I can see any such formal objection.
Thank you for your attention to this continuing dispute.
Craig W. Englund (talk) 17:37, 19 November 2019 (UTC)
- Dear Mr. Englund, as noted at File talk:‘Lamplight’ - William Henry Hunt - 1830.jpg, this issue was discussed on the Help desk, but both parties did not accept the suggested compromise. Thus, steps 1, 2, and 3 outlined in COM:DISPUTE, Basic dispute resolution, were unsuccessful in settling your objection. The next step outlined in More advanced dispute resolution would be for you to take your dispute with Pigsonthewing to COM:ANU. JGHowes talk 18:05, 19 November 2019 (UTC)
- "I noted that 'to my knowledge, no one has filed an objection' to your proposed resolution." And I pointed out then that that claim was false.

Ohmdenosaurus license was aviable...and was deleted without any review
[edit]So File:Ohmdenosaurus Reconstruction.jpg was deleted when now has the same license as https://en.wikipedia.org/wiki/Emausaurus#/media/File:Emausaurus_Hagen_Theropod.jpg without any proper review. There was an old version without license, altrougth this havea deviantart displayed license of creative commons. Instead of delete, can have been reviewed: the proper can be seen on the Deviantart page of the image: https://www.deviantart.com/lucas-attwell/art/Ohmdenosaurus-778182641
-User talk:Yewtharaptor 4/2019 17:37, December 4, 2019 (UTC)
- Was the license changed by the copyright owner, Lucas Attwell, on deviantart? When we looked, the license had an NC-ND restriction. As you know, non-commercial and/or non-derivative restrictions are not permitted at Commons. JGHowes talk 18:02, 4 December 2019 (UTC)
- Yewtharaptor also pinged me; I'm a Commons:License reviewer and can confirm that right now, https://www.deviantart.com/lucas-attwell/art/Ohmdenosaurus-778182641 does say "Creative Commons Attribution-Share Alike 3.0 License". (It also says "User Yewtharaptor has the rigths for the image on Wikipedia", but that's not necessarily useful, since we actually need the image to be freely usable everywhere, not just on Wikipedia, but the first statement will suffice for that. Just a note for the next time you (er, Yew...) ask someone to release an image for us. Thank you!)--GRuban (talk) 19:36, 4 December 2019 (UTC)
- The license was changed. As the speedy nominator, and as an admin who was a LR, I can confirm it had an NC-ND restriction at the time of upload (this is indeed implied by "So File:Ohmdenosaurus Reconstruction.jpg was deleted when now has the same license"). That this "was deleted without any review" is entirely disingenuous. Эlcobbola talk 19:45, 4 December 2019 (UTC)

Grazie in anticipo! --DeLo 99 (talk) 16:53, 5 May 2020 (UTC)
Can you reinstate the photo of me or must I upload again?
[edit]Per email thread included here, the Wikimedia permissions form has apparently been filled out by an authorized person at the Information School, University of Washington (for use of the photograph taken of me that you apparently deleted). It is not at all clear to me how to proceed at this point. Must I upload the photo again or can it be reinstated? If I upload then how to connect photo to permissions form?
William Jones
p.s. I do understand that for those familiar with Wikimedia Commons, the answers to these questions may seem obvious. But it would also seem important to engage a larger audience of contributors who may not (at all) be so well versed in the ins & outs of Wikimedia Commons.

Hi again Alicia, just a follow-on to the message below that I sent last week. Would there be any problem with you (or someone else in an official capacity at the iSchool) taking a few minutes to complete the following on-line form: https://tools.wmflabs.org/relgen/ ? Thanks for your attention to this matter. Wm
p.s. This so that the photo of me might be used in the Wikipedia article (as mentioned below). I think this is a win/win (win) e.g., the photo (taken at the iSchool and used at one point in the montage outside the main entrance to iSchool offices) strengthens the article and the article reflects well on the iSchool.

Hi Alicia, I’m reaching out to you as Jennifer’s successor and forwarding, as I do so, an exchange I had with Jennifer last fall in preparation for a talk I gave at in the iSchool research symposium at the end of October. (how long ago this seems now…) I wanted to use a photo of me taken at the Information School back in 2009 (I think). (The photo was actually used for many years as part of a montage on display at the entrance to the main offices for the Information School) Although the photo shows a younger me (11 years younger) I thought it would work well in a Wikipedia article about me that others have written (https://en.wikipedia.org/wiki/William_Paul_Jones). The photo is nicely evocative of my work on personal information management and the article itself makes it clear that much (most) my work in this area happened while I was at the Information School.
Jennifer checked and affirmed that it was “totally okay” to use the photo (per exchange below). So I posted to Wikimedia Commons ( https://commons.wikimedia.org/wiki/File:William_Jones_at_the_University_of_Washington_in_2009.jpg) and referenced in the article. (I as the subject of the article, can’t post content – but can make adds such as this).
All was fine until a few days ago when I received a notice that more formal approval was needed; otherwise the photo was proposed for deletion. I believe all that is needed is for you (or possibly Carole), as representative of the iSchool, to step through the following on-line form: https://tools.wmflabs.org/relgen/ I greatly appreciate your time and trouble to complete the formal release. Please contact me (email or feel free to call, 425 765 5876) if you have any questions. Thank you. William Jones

Hi there.
I uploaded this file and had back-and-forth with Commons Admin many years ago. Am unclear why this has been deemed a copyright violation. This file and angle do not appear anywhere in the motion picture. Nor will you find it anywhere else. That is because I made this picture in the manner previously stated, and I have granted free use of it. I directed the film. My name is on the file. What further proof do you require? — Preceding unsigned comment added by Fotofixer17a (talk • contribs) 12:48, 21 June 2020 (UTC)

- Files uploaded from elsewhere on the web require written verification that the free license is from the copyright owner. See COM:OTRS for details on how this is done. Without it, your uploads will be deleted, as you have already been informed on your talk page. JGHowes talk 13:14, 29 August 2020 (UTC)
Hi, the screenshot that was deleted is from a YouTube video and there are many other examples of similar screenshots being used for Wikipedia articles. For example: https://en.wikipedia.org/wiki/Ariana_Grande, https://en.wikipedia.org/wiki/Tzuyu, etc. What is different about this one? Solemn Penance (talk) 22:53, 30 August 2020 (UTC)
- I can understand why you might question this. The explanation is that those two YouTube videos have the free {{YouTube CC-BY}} license, which is allowed at Wikimedia Commons. The standard YouTube video license, however, is non-free. So if you want to contribute a screenshot from a YouTube video, you must confirm that the CC-BY license has been specified. If this license is not shown, the standard nonfree license applies. — JGHowes talk 23:19, 30 August 2020 (UTC)
- I see. I went through videos where the licence should be present and couldn't find it on some, but I also noticed {{Change-of-license}} is present sometimes. So only a picture that has the proper license stated at review is accepted, but that seems highly dependent on how fast the picture is reviewed. Solemn Penance (talk) 00:26, 1 September 2020 (UTC)

Cordial greeting and thank for the info. Macucal (talk) 01:15, 19 September 2020 (UTC)
- But the design is not the same. For example, in File:CoA Anton Teuma.png the cross is above the hat, not beneath it:

Hi
[edit]Can you take a look at File:Milano skyline 02.jpg (nominated for deletion) and see how the issue can be solved?
The photo was uploaded in Wikicommons by some user as a "free to share and remix" file. However this was a copyright infringment. Now the actual author of the photo showed up in the discussion and is arguing that 142 users have used her file without her approval. She (rightly) wants an immediate deletion. However, probably by accident, she didn't go for rapid deletion...instead she opened a normal deletion and, 7 days ago, she said she wanted the file to be immediatly eliminated or she will to start a legal action. She also wants to be informed via e-mail of the deletion. I told her she just needs to eliminate the file via rapid deletion, but this was reverted (i understand you are technically correct). So that's the story. My guess is that she doesn't speak English, so there's a problem in communicating with her. Thank you for reading this.
(User:DMacks, I also wanted to inform you about this.)
Hopefully the normal deletion process comes to an end and the file is eliminated.
