Goodies, tips, and tricks

Pretty such the same thing as given above also applies to File:Oren Ritter Lewis.png. You seem to be misunderstanding some important things about image copyright and what the term "own work" means, particularly with respect to the type of content that Commons accepts. I suggest you take a close look at Commons:Licensing as well as Commons:Copyright rules by subject matter#Internet images and Commons:Own work for further information. It's OK to make a mistake and nobody is expecting that you understanding all of Commons policies right off the bat, but there are some important thing about Commons that you should try and gain a better understanding of before uploading any more image files. Unless you're claiming that you took this photo yourself (which doesn't seem to be the case given the file's description), the COM:CONSENT of the person who did is going to be needed for it to be kept by Commons. While it's true that there's freedom of panorama in the United States for buildings, the photo itself is still eligible for copyright protection. Even if the author is unknown to you, it is still eligible for copyright protection as an anonymous work as explained here. Given the photo is described as being taken in 2015 and can be seen used in other places online (like here), Commons is unlikely going to be able to keep it without some kind of more formal verification of it's licensing. Generally, it's the person who takes a photo who is considered to be it's copyright holder and if that's you in this case, please follow the instructions in Commons:VRT#Licensing images: when do I contact VRT?. This photo is likely what is considered to be a derivative work as explained here and here. When uploading a photo of signs such as this one, there are generally two copyrights that need to be taken into account: the one for the photo and the one of the sign. Even if you're able to get the COM:CONSENT of the person who took the photo, you would still need the consent of the creator (i.e. copyright holder) of the sign for the file to be kept by Commons. -- Marchjuly (talk) 22:18, 8 March 2022 (UTC)[reply]

If you're uploading photos attributed to other persons, you need to provide a way of verifying that person's COM:CONSENT. There are a few ways this could be done, but something explicit showing that copyright holder (i.e. the photographer) has given there consent is needed for Commons to keep the file. Most of the files you find online (even ones in which the author is unknown) are going to be assumed to be protected by copyright as explained here even if it doesn't explicitly say so; moreover, many websites host content provided by third-parties which means that the website itself is not going to be considered the copyright holder in most of these cases and formal verification is going to still be needed. -- Marchjuly (talk) 22:26, 8 March 2022 (UTC)[reply]

The copyright holder of a photo is the person who takes the photo and the file's description says that this person is unknown. The subject of a photo or a website hosting a photo is not the copyright holder by default when the photographer is unknown. The website must have gotten the photo from somewhere. If the person who runs the website took the photo, then that person is the copyright holder and their COM:CONSENT is needed. If someone posted the photo on the website and that person took the photo, then that person is the copyright holder and their consent is needed. You cannot claim a file has been released under a free license that Commons accepts if you don't know who took the photo because anonymous works are still considered protected by copyright under US copyright law in many cases as explained here. -- Marchjuly (talk) 23:14, 8 March 2022 (UTC)[reply]

I removed the file once, you re-added it and it was then removed by another editor. You can ask them about it at en:Talk:Seymour, Indiana or en:User talk:Ohnoitsjamie, but be advised that that editor is a Wikipedia administrator and it might be best to re-add the photo until it's licensing issues have been resolved. As for whether the photo is "too old" to be protected by copy right, more information is going to be needed about it's en:provenance than you've provided on the file's page for such a thing to be determined. You mentioned that the photo was taken by a friends family at en:User talk:Marchjuly#Walton Hotel and that's somewhat helpful, but copyright status typically depends not when a photo was taken, but when it was first published as explained here. Photos taken and first published prior to January 1, 1927, are typically considered to be too old for copyright protection in the United States per COM:United States, but 1950 is not really that old in terms of copyright law; so, even if the photo was first published in 1950, it wouldn't necessarily be free from copyright protection. If you know who took the photo and can get their COM:CONSENT, then Commons can probably keep it. If the photographer is no longer living, then the copyright ownership of their work has most likely passed on to their heirs and the consent of the heirs may suffice. Otherwise, it's going to be hard to keep the file as licensed without some sort of formal verification. -- Marchjuly (talk) 23:54, 8 March 2022 (UTC)[reply]

You can disagree if you want, but this is the way Commons policy is applied and it's up to you to justify that the content you're uploading to Commons is properly released as you're claiming as explained here. If you know who the copyright holder (i.e. the person who took the photo) is, then you will need to get their COM:CONSENT. The most common way of doing so is to have that person send an email to the Wikimedia Volunteer Response Team as explained here. Once the copyright holder's consent has been verified, a VRT member will amended the licensing as needed and add something to the file's page that states the copyright holder's consent has been verified. When you ask for the copyright holder's consent, you should explain to them things like Commons:Licensing and Commons:License revocation to make sure they understand what it means to give their consent. Basically, they will be agreeing (in advance) to allow anyone anywhere in the world to download the photo from Commons at anytime and reuse for any purpose (including commercial and derivative use). They won't be able to place any restrictions on how others use their photo except to require that they be attributed as the original photographer whenever it's reused. So, as long as other people state where they got the photo from, they can pretty much reuse it anyway they want. If the copyright holder doesn't want this, they shouldn't give their consent because there's no going back once they do. There is no freedom of panorama for publicly displayed works of art (including murals like this) in the United States which means that the copyright status of the photo and the work being photographed needs to be taken into account as explained here. So, the consent of the photographer and the consent of the artist who painted the mural are needed for this file to be kept by Commons. I've retagged this file based upon the source information you've provided above and on my English Wikipedia user talk page. If you can get the consent or either your friend or your friend's family and ask them to mail it to Commons VRT as explained above, this file would probably be OK to keep. Otherwise, when it might possibly be considered public domain depends upon when it was first published. If, for example, your friend took the photo but it was never published (as defined here), then per COM:HIRTLE it would seem to fall into the public domain 70 years after your friend's death (70 pma). If, however, it was published at some point, then the actual date of publication matters. If it was published prior to 1977 without a visible copyright notice (the notice could be either on the front or back), then it would be probably OK to license as {{PD-US-no notice}}. If it was published prior to 1963 with a copyright notice but that copyright notice wasn't renewed, it could be OK to license as {{PD-US-not renewed}}. There are other possibilities as well, but they all depend on the date of first publication and there needs to be some way to verify any of those that goes beyond stating when the photo was likely taken.

Just for reference, the license you've uploaded the file on actually states that the photo is still protected by copyright and that the copyright holder has agreed to release a version of it under a Creative Commons license that the Wikimedia Foundation accepts. This is quite different from claiming that the file is either no longer eligible or never was eligible for copyright protection, and only the copyright holder of a work can release it under a Creative Commons license.

Finally, if this or any of the files end up deleted before their licensing can be verified, don't reupload them. Files which are deleted aren't gone forever (they're only hidden from public view) and they can be fairly easily restored by a Commons administrator per COM:REFUND once their issues have been resolved. If you're able to get the copyright holders to send consent emails to Wikimedia VRT, you can add the template {{Permission pending}} to those files' pages and this will give an extra 30 days for the files' licensing to be verified. -- Marchjuly (talk) 04:19, 9 March 2022 (UTC)[reply]
