- Hola Imalbornoz, la verdad es que la conclusión que sacas no me parece correcta. Que se publicase antes de 1923 no es significativo fuera de Estados Unidos. Es la legislación española la que aplica. En principio, puede argumentarse que han pasado más de 80 años desde la publicación, pero sin saber quién es el autor es difícil dilucidar si efectivamente está en el dominio público o no. Desgraciadamente aquí se aplica el precautionary principle y eso significa que el "se supone" o "nadie ha reclamado" no es argumento suficiente. Yo creo que lo mejor sería transformar la indicación de falta de fuente en una petición de borrado regular, que implica argumentación, y exponer ahí los argumentos que me das. En el caso peor, siempre puedes subir la foto a la wikipedia en inglés invocando "fair use" (de hecho, el artículo en inglés está mucho mejor que en español).
