[edit]Hallo Hickmann, eigenes Werk heißt nicht, dass du ein Foto von einem Foto gemacht hast, oder ein Foto eingescannt hast, oder ein Foto hochgeladen hast, sondern dass das ursprüngliche Foto von dir stammt. Bitte überprüfe all deine noch verbleibenden Bilder darauf, ob sie wirklich dein eigenes Werk sind und darauf, ob das Erstellungsdatum (capture date) in der Beschreibung stimmt. Falls es nicht deine Fotos sind, werden sie früher oder später gelöscht werden. Du kannst allerdings den Fotografen / die Fotografin / den Rechteinhaber / die Rechteinhaberin um eine Freigabe für die WP ersuchen, die Bilder von Hallein fallen schon in den Scope von Commons, sind nützlich. Recht am eigenen Bild

Du hast hier ein schönes Bild von leuchtenden Kinderaugen neben einem "Goldberg" hochgeladen. "Own work" bedeutet, wie Dir oben schon gesagt wurde, dass Du dieses Foto selber gemacht hast. Und das wiederum bedeutet, dass die abgebildete Person mit an Sicherheit grenzender Wahrscheinlichkeit noch nicht lange genug tot ist, damit ihr Recht am eigenen Bild keine Rolle mehr spielen würde.
Sofern es sich nicht um Dein eigenes Kind handelt, über dessen Bildrechte Du als Elternteil zu entscheiden hast, halte ich das für problematisch. (Ich persönlich halte es auch für problematisch, wenn Eltern Bilder ihrer eigenen Kinder öffentlich online stellen, aber das ist nur meine persönliche Meinung und nicht die der Juristen.) Der Artikel Goldberg, auf dem ich dieses Foto eingefügt habe, wird ohnehin gelöscht. Aber zum Bild: Da hat mich meine 98 jährige Mutter fotografiert, wer ihre Urheberrechte besitzt, wenn sie nicht mehr richtig ansprechbar ist, das weiß ich nicht. Das Kind bin ich vor ca. 60 Jahren. - Hallo Hickmann, danke für die Auskunft! Damit ist auf jeden Fall die Frage nach dem "Recht am eigenen Bild" geklärt - das liegt in dem Fall natürlich bei Dir selber. :-)
- Das Urheberrecht hat genaugenommen immer noch Deine Mutter. Ich würde in dem Fall wohl pragmatisch vorgehen: Du kennst wahrscheinlich den mutmaßlichen Willen Deiner Mutter am besten. Wenn sie die Fotos ihres Kindes gerne herumgezeigt hat und ihr selber auch am Erhalt dieses Brauchtums gelegen war, dann wäre es sicher in ihrem Sinne, dass Du das Foto hier hochlädst.

Transfer into German language / Übertragung ins Deutsche: Ein Foto aus dem Jahr 1921 kann nicht als "Eigenes Werk" bezeichnet werden. Das Digitalisieren eines fremden Fotos ändert nichts an der Urheberschaft des Fotos; Urheber bleibt der ursprüngliche Fotograf, auch falls dieser unbekannt sein sollte.
Die Datei auf Commons benötigt also folgende Aktualisierungen:
- Angabe der Quelle, hier vermutlich eine Publikation, Buch, o.ä.

setzen. - Die passende Lizenz ergibt sich erst dann, wenn die Angabe zum Autor (Fotografen) final ist: Wenn ein konkreter Fotograf angegeben werden kann, dann ergibt sich die passende Lizenz aus dem Sterbedatum des Fotografen; bei einem unbekannten Autor (Fotografen), ergibt sich die Lizenz aus dem Aufnahmejahr "1921", was dann auf Grund der "nur" 103 verstrichenen Jahre problematisch wird.

- Hallo Archie02!
- Das Foto ist aus dem Nachlass meines Großvaters Max Domenig und ist Teil meiner Sammlung (Sammlung Hickmann). Da Alfred Roller in dem von mir erstellten Artikel, Max Domenig, erwähnt ist, wollte ich diese historische Fotografie hineingehen, muss aber nicht sein. Ich werde sie wieder entfernen. - Hallo Herr Hickmann, das Problem bei all diesen Dateien um diese Zeit mit unbekanntem Fotograf ist ja die 70-jährige Schutzfrist (Werk ist erst 70 Jahre nach dem Tod des Autors urheberrechtsfrei). Der Fotograf kann 1921 sagen wir mal erst 20 Jahre alt gewesen sein und wenn er z.B. 80 Jahre alt geworden ist, wäre er erst 1981 gestorben, womit das Bild erst 2051 urheberrechtsfrei wäre. Aufgrund der internationalen Rechtslage ist man auf Commons recht streng, und es können daher leider viele wertvolle Aufnahmen nicht behalten werden, auch wenn sie von nicht-professionellen Autoren stammen dürften.
