My wife, Llyneira, was among the contributors, and her feelings were hurt by their "children drawings" remarks. She did not know at the time that the offender was just some rando, and felt her drawings were rejected by someone with more standing and authority. RfC: Third-party images published by the National Weather Service

I've now reviewed 1,000 images uploaded under the rationales expressed in the {{PD-NWS}} template and requested deletion of several.

The arguments for deletion, and to keep, are now following repetitive, predictable patterns and it would greatly help all involved if we could centralise discussion and obtain some wider community input.

Therefore, I have opened an RfC to gather opinions. Apologies in advance: it's long and detailed, but is frankly nothing compared to the words and time expended by all parties up to this point. Probably the most crucial issue revolves around how we interpret a general disclaimer published at weather.gov (Q.1 in the RfC).

Back in August, you say you'd emailed the NWS HGX office about the copyright and licensing of File:2020aug-derecho-corn-sunset-Adel-IA.jpg. Did you ever hear back? I'm following up a few loose threads and been emailing a few offices. Thank you for following up, @Rlandmann, I have been very busy and not very active on Wikipedia due to many circumstances. However I have the emails I exchanged available below:
The following is a conversation I had with the DMX NWS office webmaster:

To Whom It May Concern: There are currently disputes on Wikipedia and Wikipedia Commons regarding the intellectual property rights or lack thereof for submitted pictures which are hosted on NWS storm reports. Previously, many different office-dependent submission forms existed with their own photo submission guidelines and the rights given or relinquished thereby. Currently, many of the storm photos from the August 2020 derecho DMX report are being considered for deletion from Wikipedia after being hosted for the last three years by Wikipedia under the auspices that photos submitted to and hosted by the NWS as part of official reports are Public Domain unless otherwise marked as such. Please advise regarding the specific releases the Des Moines office received for those photos in the August 2020 report. Thank you

Hello Gwen. I don't fully understand the questions you're asking and how they relate to Wikipedia and/or the NWS. What I can say is that for any photo or video we use and publish on our websites, we will note right in the caption who it is from and by extension, that means we have written (nowadays email) documentation from the person who took the photo or video. Ah. Let me explain. Wikipedia only allows itself to host freely-licensed (e.g. Creative Commons) or public domain works. By default, published works created by the US government or its parts are public domain. However, there is a dispute right now on Wikipedia Commons whether images hosted at https://www.weather.gov/dmx/2020derecho are freely licensed. Basically for the purposes of copyright law and Wikipedia, some editors have questioned the copyright licensure of these files. To the point, did NWS DMX in its submission requirements for the photos require the release of copyrights by the original photographer and entry into the public domain?

Hello Gwen. About all I can say about the images for this event, and any images/videos we post is that the user gives us the right to post them on our webpage and use them in training. If we don't receive the OK for those activities, we don't post them or use them in training. That's all we ask them. Regards, Shane

Does NWS DMX have a standardized submission form or written release which members of the public fill out to submit the images? If so, can I get a copy? So permission was given to the NWS to host, utilize, and distribute the images? Is it possible to get contact information for certain submittants to verify the copyright status of their submitted media?

Hello Gwen. We don't use a form - when someone submits an image/video and if we think we might use it in the future, we'll simply ask (email, SMS, direct Facebook message, etc.) if we can use it for training purposes and in an event review we post. Then we save their response. I'm guessing without a formal FOIA request, we would be unable to share any particulars with external parties. Regards, Shane
