Welcome to Wikimedia Commons, Grbb!
File:Nick Baker (KY Senate).png has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

Good afternoon, what is the source where you found this image? It appears to be from an online newspaper depository. Unless you took the photo yourself, it should not be marked as your "own work." -Mad Mismagius (talk) 18:53, 18 August 2024 (UTC)[reply]

This is a still from the Appalshop produced film Girls' Hoops (https://appalshop.org/shop/girls-hoops). I own a copy of the film and took the screenshot from there. Does it need to come down? Grbb (talk) 19:29, 18 August 2024 (UTC)[reply]
In that case the image would not be fair use as it would fall under the copyright of the documentarian or whoever took the photograph. -Mad Mismagius (talk) 19:59, 18 August 2024 (UTC)[reply]
As I read it on Wiki's own page about fair use, "Any such media on Wikipedia ought to be a small part of the copyrighted material as a whole, and at the very least be of such inferior quality from the original that it could not be reasonably considered an acceptable alternative to the original. Where possible, the original copyright holders, when known, should be clearly marked, indicating both that Wikipedia does not claim copyright over the media in question, and allowing those who would seek to license the media or purchase copies of the media from the original copyright holder to legitimately and easily do this."
This particular image is a small part of copyrighted material, is of inferior quality, and can't be construed as an alternative to an hourlong documentary. In addition, I'm willing to mark the source of it. I think the same also goes for the Ky. Senate archival photo, which was itself in public domain (public records) and not copyrighted by any business or profit-generating entity. I have seen numerous examples of such use on Wikipedia before. Grbb (talk) 20:09, 18 August 2024 (UTC)[reply]
While Wikipedia allows fair use in narrow circumstances, such images are not allowed on wikimedia commons. See COM:FAIR. -Mad Mismagius (talk) 21:11, 18 August 2024 (UTC)[reply]
