Sobre el Departamento de Estado

Por favor evita líos. Solamente las imágenes que el Departamento de Estado de Estado Unidos haya subido aquí están libres de derechos de autor, el resto no. La de Osama Bin Laden, la del miembro de la Farc y otras, todas tienen copyright. Lo dice explícitamente en su política de derechos de autor.

«Por favor note que muchas de las fotos usadas en este sitio tienen copyright. Solamente las fotos del Departamento de Estado están en el dominio público.»

Por favor, busca una a una las imágenes de la siguiente lista en el link que dí, si no las encuentras quiere decir que deberás retirarlas, el enlace que presentaste no es válido para garantizar que están en el dominio público.

Otro asunto, ¿sabés la diferencia entre un trabajo derivado y un trabajo propio? ¿Por qué no hay metadatos en File:Estrella de Carabobo 1.jpg, File:Orden Francisco de Miranda 1.jpg, File:Cruz del Ejercito Venezolano 1.jpg, File:Dijin P.jpg, File:Revista semana F.jpg, File:Logo FGN.jpg y File:Dimmu B.jpg? Si tú tomaste la fotografía o si las has creado con algún programa deberían haber metadatos que corroboren tu autoría. Si las has recortado del original, también habría pruebas del delito. Pero así me inducen a creer que hay otra fuente, dame más información, sé más explícito. ¿Cómo las obtuviste? Recuerda que ya no puedes decir que las creaste con un programa o que tú tomaste las fotografías. Te queda que las hayas escaneado: sería un trabajo derivado. Probable violación de Copyright.

Con respecto a los tres últimos, la situación es aun más delicada pues son logos comerciales idénticos al original. Eso está prohibido en Commons. Por favor lee: Commons:Sobre las licencias y Commons:Trabajos derivados, así te ahorrarás más dolores de cabeza.

¿En File:Alchemy Sulfur Symbol used by Satanists2.jpg hiciste una obra derivada? Simplemente no lo entiendo, de por sí has citado mal la fuente, pues así estás diciendo que en:File:Sulfur symbol 1.svg es una copia exacta y eso no es verdad. Además la subiste a en.wikipedia con exactamente la misma información de origen. Ayúdame a ayudarte. Si es una obra derivada cambiamos la cita de la fuente y listo. Pero para mí, caen en la misma lista de origen dudoso de más arriba.

File:Cancion mobscene.jpg, File:E concierto.jpg estas fotos es cierto que fueron subidas a Flick con licencia válida, pero aun así se necesita autorización por escrito de quienes aparecen en ella. El autor fue al recital y tomó una foto, eso no lo autoriza a divulgarla de la forma en que lo hizo. Podría no superar una consulta de borrado. Aun así, con respecto a ese tema necesito más información. Tal vez consultando a alguien más experimentado.
No todo lo que se sube a Flick con licencia CC puede llevarla. Ese es el caso de File:Flickr.jpg, File:Colección de láminas dos.jpg, File:Colección de láminas.jpg y File:Álbum de GPK.jpg esas imágenes están violando derechos de autor. De ellas la peor es la primera, puesto que se ven claramente los detalles de las figuritas. Lo que se discute en la consulta de borrado es si esas figuritas tienen o no copyright. Si las figuritas lo tienen, la foto también. Eso es un ejemplo más de obra derivada.
File:Matthew McDonough m.jpg, File:Greg Tribbett m.jpg, File:Chad g.jpg tienen un epígrafe incorporado con el famoso logo (C). Según Flickr, el autor publicó las imágenes con CC-BY-SA-2.0. En este caso eso no parece fácil de demostrar pues cualquiera podría estar suplantando identidad. Suponiendo que son legítimas, lo ideal es una autorización mediante el sistema OTRS, es lo que se recomienda en casos así. Y luego realizar otra imagen en donde le recortes el epígrafe. Solo que no me acuerdo donde enlazar para que leas esto. Ten en cuenta que CWG Magazine no publica bajo CC-BY-SA-2.0, sinó que se reserva todos los derechos. Y si vas a su página web (http://www.cwgmagazine.com) verás que ellos reconocen su autoría sobre una página en Twiter, otra en Facebook y una más en YouTube. No dicen nunca que tengan una página en Flickr. Casos así se dirimen mediante autorización explícita.

Otro punto a tener en cuenta en el futuro. Has tomado dos imágenes de minneapolisfed.org, pero el sitio aclara que no puedes usar ningún logo, imagen o gráfico pues todos están protegidos por derechos de autor. Para ello se necesita una autorización escrita (como con cualquier medio que esté protegido). Lo dice aquí. Antes de subir imágenes de sitios que te perezcan seguros, es mejor leer sus políticas. Aunque nos duela la vista que todas estén en inglés... En este caso no puedes argumentar nada, File:Simon_Kuznets_NOBEL.jpg y File:Robert E Lucas.jpg muy probablemente sean borradas por no ser imágenes libres.

En File:Ratm demotape.jpg no estás citando el origen de la imagen. Enlazas a en.wikipedia a otra imagen que tú mismo subiste con la misma descripción, incluyendo el grave problema de que allí afirmas que la fuente es exactamente esa misma página (¿?). Enlazas a un usuario diciendo que es el autor y la cuenta no está registrada. Pero entiendo que si lo está en la wiki inglesa. De todas formas deberías corregir eso aquí, puesto que, insisto, ese usuario en Commons aun no existe. Doy por descontado que tendrás alguna fuente que garantice una licencia compatible, si es así este es el momento de decir cuál es. Si no lo haces tú, siempre se puede ir al autor y preguntarle. No creo que objete, pero deberá dejarlo explícito en la página del archivo.
El mismo error en File:Natybotero2.jpg, la subes a en.wikipedia y luego vienes a Commons y dices que la fuente original es la wiki inglesa. Pero esta vez en la inglesa ya te la borraron, el borrado en Commons será cuestión de tiempo.
En File:Maryland my maryland2.jpg hice unos cuantos cambios, puedes pasar por allí y tomarlos como base para archivos que subas en el futuro.
Espero que leas todo esto cuidadosamente y obres con más cautela, casi todo lo que has subido probablemente sea borrado. Y sé que no has actuado de mala fe, el asunto es que no todo es lo que parece allá afuera. Lo mejor es informarse bien y moverse siempre sobre seguro. En tu lugar me iría buscando alguien que sepa inglés y me inspire confianza. Así ante cualquier duda tendría a quien preguntarle. Either the image was created by someone else, or it is a derivative of someone else's work. As stated in Commons:Licensing, only the copyright holder may issue a license, so the one shown on Flickr is invalid. Always remember to critically evaluate Flickr licenses. Photostreams with professional-looking photographs, album covers, posters, and images in a wide range of styles or quality taken by many different cameras often indicate that the Flickr uploader either does not understand or does not care about copyright matters.
