File:Snowspeeder.jpg has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.
If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. Derivative images
[edit]We're not talking about FOP but {{Derivative}}. Regards. --Dodo (talk) 11:38, 13 March 2011 (UTC) PS. I don't care about challenges at Frenk Wikipedia. Please use Commons' talk pages instead of emails to discuss about deletions.
- I've read Commons:Deletion requests/Madame Tussauds, Commons:Deletion requests/Wax figures and Commons:Deletion requests/Wax figures at Tussauds. What's your point? --Dodo (talk) 14:08, 13 March 2011 (UTC) PS. Be cautious using the "here you have images with the same problem" because a) you might be wrong about the cases being identical, and b) the "solution" may be the deletion of those ones too, instead of restoring the first image.
- you should read Commons:Deletion_requests/Archive/2010/09/09#File:Madame_Tussauds_London_00801_Nevit.jpg. The ones from London, where COM:FOP applies inside museums.--Crazy runner (talk) 14:12, 13 March 2011 (UTC)
You are *wrong*.
- "sculptures, models for buildings and works of artistic craftsmanship (if permanently situated in a public place or in premises open to the public)." Neither the wax statues are permanently installed inside Madame Tussaud's (which is NOT a museum, by the way), nor those are premises open to the public (you have to *pay* to enter). Are yo trying to say that taking a photo of a movie inside a theater is OK at UK? Or from a modern sculpture exhibited at an English museum?
- In any case, the images we are talking about are touristic shots of a girl inside a wax museum. Out of scope, I'm afraid.
Regards. --Dodo (talk) 14:18, 13 March 2011 (UTC)
Ooops. I forgot: besides, some of those wax figure have the additional problem of being themselves derivative works of comic characters. Additional copyright holder means additional copyright permission. Do you have it? --Dodo (talk) 14:22, 13 March 2011 (UTC)
"The practical effect of the broad Freedom of Panorama provisions in the UK and in other countries with similar laws is that it is acceptable to upload to Commons not only photographs of public buildings and sculptures but also works of artistic craftsmanship which are on permanent public display in museums, galleries and exhibitions which are open to the public. According to Copinger and Skoane James, "The expression "open to the public" presumably extends the section to premises to which the public are admitted only on licence or on payment". Again, this is broader than 'public place' which is the wording in many countries."--Crazy runner (talk) 14:25, 13 March 2011 (UTC)
I think "artistic craftsmanship" can hardly be understood as "derivative works of previously copyrighted subjects, such as comic and movie characters". Please read http://www.madametussauds.com/London/NewsAndEvents/Marveldisclaimer.aspx And COM:SCOPE. Regards. --Dodo (talk) 14:27, 13 March 2011 (UTC) PS. I have just written an email to Madame Tussauds London asking them about this issue.
Thanks you for your answers, I hope it is possible to use them. Commons_talk:Licensing/Archive_8#Madame_Tussauds. Regards.--Crazy runner (talk) 15:21, 13 March 2011 (UTC)
- I doubt it. Hulk & co. are copyrighted by Marvel. I doubt that a license agreement between Marvel & Madame Tussauds London + UK FOP make those right magically disappear! --Dodo (talk) 20:14, 13 March 2011 (UTC)
- You need only the UK FOP. Commons:Fan_art#Freedom_of_panorama. Can you stop to be sarcastic ? --Crazy runner (talk) 20:58, 13 March 2011 (UTC)
- I believe the images in doubt should be un-deleted and a formal deletion request be opened. --Nevit Dilmen (talk) 21:17, 13 March 2011 (UTC)
- I'm not being sarcastic. I just wonder why does Madame Tussauds London have a copyright warning at its website [1] if English FOP makes legal all the possible uses of the photos made by visitors. Any ideas? --Dodo (talk) 00:15, 14 March 2011 (UTC)
BTW, I have restored File:Hulk Madame Tussauds 02.jpg. File:Superman Bensonnhurst.jpg, on the other hand, comes from en:Bensonhurst, Brooklyn, so bad luck: FOP only applies there to buildings, not artworks (see COM:FOP#United States). OK? --Dodo (talk) 00:33, 14 March 2011 (UTC)
- Oh, I nearly forgot: according to this, the exhibition of Marvel Super Heroes at Madame Tussauds London is a "five year deal", so they are not permanently displayed, so UK-FOP does not apply, so... should anybody delete these photos? --Dodo (talk) 00:37, 14 March 2011 (UTC)
- If you are not creating a Commons:Deletion request, what will do the next user that is interested by Madama Tussauds London if he watchs the last Deletion request ? He will say UK FOP and put his file.--Crazy runner (talk) 03:45, 14 March 2011 (UTC)
- I am not creating a DR because of this. Sorry. --Dodo (talk) 07:38, 14 March 2011 (UTC)
