I regret having not clearly tagged the picture of Peter Deckenbacher. In fact it was originally taken by Ms. Carina KARLOVITS, official photographer of the Austrian MoD. Bergauer Otto (talk) 18:07, 6 April 2022 (UTC)[reply]

Mein Freund hat mir die Antwort seines Dienstgebers, die etwas gedauert hat, übermittelt und gleichzeitig an permissions-de@wikimedia.org übermittelt. Das Bild wurde zwischenzeitlich gelöscht. Welche Upload Einstellung ist nun die richtige, wenn der Dienstgeber schreibt:

Sehr geehrter Herr Mag.FH Mag. Deckenbacher, Bgdr,
Sie haben sich direkt an eine Mitarbeiterin von mir gewandt, da diese
als Fotografin im Jahr 2019 Portraitfotos von Ihnen hergestellt hat und
Sie diese im Web nutzen wollen. (CAR7783 und CAR7776)
Sie ist zwar, gemäß Österreichischem Urheberrechtsgesetz, als Fotografin
die Urheberin, da sie aber bei der Heeresbild- und Filmstelle, respektiv
dem BMLV, angestellt ist, jedoch nicht die Halterin der Werknutzungs-
rechte an diesen Bildern. Dies ist, wie bei einem zivilen Fotobetrieb, der
Arbeitgeber, somit das BMLV.
Da auf den Fotos nur Sie abgebildet sind, betrifft es aber auch ihre
Persönlichkeitsrechte, das sogenannte "Recht am eigenen Bild". Heisst:
Wenn nicht zwingende Gründe für eine Veröffentlichung oder Öffentlich-
keitsarbeits-Nutzung vorliegen, darf das BMLV die Fotos ohne ihre
schriftliche Zustimmung an niemanden anderen weitergeben.
Nachdem somit drei Parteien rechtemäßig betroffen sind, lassen Sie
mich es zusammenfassen:
- Für redaktionelle Nutzungen werden BMLV-Fotos kostenfrei abgegeben.
Da sie ihre Aufnahmen identisch nutzen und sich zudem kein praktischer
Nutzen daraus ziehen lässt, ist es hier genau so zu sehen.
- Da Sie selbst auf diesen Fotos erkennbar sind und Sie die Fotos selbst
nutzen, sind Sie selbst für die Persönlichkeitsrechte verantwortlich.
- Frau Karlovits hat jedoch als Urheberin den Rechtsanspruch auf die
Nennung des Urheberrechtsvermerks "BMLV / Carina Karlovits", der
entweder auf der Seite anbei stehen kann, oder, gemäß OGH, im
IPTC-Datenbereich des Fotos angeführt, ausreichend ist.
Falls Sie darüberhinaus weitere Fragen haben, können Sie sich gerne
jederzeit an mich wenden.
