Tip: Categorizing images

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.
Here's how:
1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:
2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.
[[Category:Category name]]
For example, if you are uploading a diagram showing the orbits of comets, you add the following code:
[[Category:Astronomical diagrams]]
[[Category:Comets]]
This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".
When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

Stowarzyszenie Wikimedia Polska zaprasza Cię na warsztaty fotograficzne, które odbędą się w Łodzi, 1-3 maja 2010. Twój wkład do Wikimedia Commons wskazuje, że możesz wiele skorzystać z udziału w warsztatach i podzielić się swoim doświadczeniem fotograficznym z innymi. Warsztaty są skierowane do:
- osób już wgrywających mniejsze czy większe ilości zdjęć do Wikimedia
Commons - niezależnie od ich jakości
- fototoamatorów - nie związanych dotąd z projektami Wikimedia
- zawodowych fotografów - w charakterze doradców i wykładowców
Nie ma znaczenia jaki typ fotografii preferujesz - w Wikimedia Commons jest miejsce zarówno dla portrecistów, dokumentalistów, jak i fotografów pejzażu miejskiego i przyrody. Wikiwarsztaty będą miały charakter kameralny (max. 40-50 osób) i trwały przez weekend 1-3 maja 2010 <sobota-poniedziałek>, Zajęcia będą się odbywały w Łódzkim Domu Kultury oraz w plenerze. Wiedźmin (logo)
[edit]Walczę z tą koncepcją już od dłuższego czasu. To jest prawniczy wymysł rodem z USA, gdzie łatwo jest wykręcić kota ogonem, a prawo jest ciut inne niż u nas. A nawet i w Stanach ten numer by nie przeszedł.
Są dwie podstawowe kwestie: ochrona znaku towarowego: nawet jeżeli byłaby to czarna kropka na białym tle, jest chroniona prawem jako znak towarowy i – uwaga – nawet, jeżeli znak nie został zarejestrowany. A jeżeli został, to już na pewno nie możemy go używać w polskiej wiki. Ani wstawiać na Commons jako free license. Ale, rozumiem, że nie to jest najważniejsze.
Zasadnicza kwestia, to te osławione proste kompozycje z podstawowych kształtów i liter. Zajmuję się zawodowo projektowaniem graficznym i mówię wprost: bzdura. W polskim prawie nie ma takiej opcji. A nawet, jak komuś się wydaje, że znak składa się tylko z ciągu liter i autor nie włożył w jego zaprojektowanie nic oryginalnego, to (zazwyczaj) nie ma racji. Projektowanie typograficzne jest subtelną dziedziną i dla laika wkład pracy grafika może być niezauważalny, a w rzeczywistości sztuka polega np. na ustawieniu odstępów pomiędzy literami w taki, a nie inny sposób, albo na minimalnej zmianie rysunku liter.
W konkretnym przypadku logo Wiedźmina nie ma najmniejszych wątpliwości: ani przywołana przez Ciebie zasada wymogu oryginalności nie ma zastosowania, ani nie możemy używać logo ponieważ jest znakiem handlowym. Amen.
Uzasadnienie, żeby nie było, że wymyślam: czy przyjrzałeś się detalom tego logo? Np cyferka "2": czy to tylko proste kształty geometryczne i tekst? A cieniowanie liter? Rysunek zadrapań? A w ogóle, czy wskażesz istniejący krój pisma, którego użył autor znaku? Raczej nie. Ktoś spędził nad tym tydzień pracy, a dla Ciebie to proste kształty i litery. Niestety, nie mogę się zgodzić. Licencja jest błędna i jej używanie w ogóle powinno być zabronione na Commons, albo ograniczone do oczywistych przypadków, jak napis złożony Timesem lub Arialem. A i wtedy warto się zastanowić, bo w Polsce i to może nie zadziałać (prawo autorskie chroni nawet rysunki dziecięce).
Jeżeli wstawiamy coś na Commons na wolnej licencji, to oddajemy prawo do używania tego całemu światu. W tym przypadku robiąc to, naruszasz prawa autora znaku. Może Cię (Wikipedię?) spokojnie podać do sądu. I wygra, bo ma bogatą wytwórnię po swojej stronie. Lepiej może nie ryzykować?

- Nie za wszystkim zgadzam się, niestety. Zapewne należałoby w tej sytuacji poszukać bardziej kompetentnej wykładni prawa. Jednak według mojej najlepszej wiedzy, według prawa handlowego (nie autorskiego) ochronie podlega wykorzystanie znaków towarowych nawet nie zastrzeżonych formalnie. Oczywiście nie każde wykorzystanie. Jednak domyślnie, to co jest na Commons, powinno być na wolnych licencjach, lub w Public Domain (do wykorzystania w USA, w Polsce nie działa). Ktoś może sobie ściągnąć obrazek w dobrej wierze i użyć komercyjnie, a wtedy żarty się kończą. I nie pomoże Floryda. Ostatnio mieliśmy takie rozważania prawne przy okazji pornografii: według polskiego kk miejscem popełnienia przestępstwa jest miejsce jego popełnienia: "Art.6. § 1.Czyn zabroniony uważa się za popełniony w czasie, w którym sprawca działał lub zaniechał działania, do którego był obowiązany. §2.Czyn zabroniony uważa się za popełniony w miejscu, w którym sprawca działał lub zaniechał działania, do którego był obowiązany, albo gdzie skutek stanowiący znamię czynu zabronionego nastąpił lub według zamiaru sprawcy miał nastąpić.". No ale na razie nie popełniamy przestępstwa, mam nadzieję.
- Co do niechronienia krojów pisma: w tym przypadku nie chodzi o krój pisma, tylko o kompozycję graficzną, czy logotyp, które chronione są. I oryginalność w danym przypadku jest oczywista. I raczej każdy rzeczoznawca przyzna mi rację (no chyba, że grafik robiący ten znak dopuścił się plagiatu, w co szczerze wątpię). Tu bym się upierał raczej.
- Co do licencji o prostych kształtach: upieram się, że nie należy jej stosować w ogóle. Było to już dyskutowane na Commons i nie jestem odosobniony w tym zdaniu. Jest to nadużycie i wytrych, a nie prawdziwy stan prawny, który można by wykorzystać w praktyce. A nawet, jeżeli można w jakimś konkretnym przypadku zastosować, to tylko w USA, bo, o ile mi wiadomo, polskie prawo nie przewiduje takiej furtki. Usunięcie pliku z Commons nie jest lepszą opcją, niż zmiana licencji, bo właśnie w Stanach używają znaków towarowych w celach informacyjnych (w enwiki jest mnóstwo takich artykułów). Natomiast, o ile mi wiadomo, plwiki nie może robić tak samo. Stąd mamy plik na Commons, ale my nie możemy go umieszczać w artykułach. Nie wiem, czy to jest dobrze, ale tak na razie jest. Jednak pozostawiając plik na Commons, nie możemy wprowadzać użytkowników w błąd, podając naciąganą licencję. Dlatego usuwam licencję w ogóle, bo nie ma tu możliwości użycia żadnej znanej mi wolnej licencji. Po prostu, znak jest zastrzeżony (= chroniony, i na płaszczyźnie prawa handlowego i na płaszczyźnie prawa autorskiego; wolno go sobie pooglądać, ewentualnie prywatnie wydrukować na koszulce, ale używać publicznie to już ostrożnie).
- A propos podawania do sądu: oczywiście, że szansa na to, że ktoś mnie czy Ciebie personalnie poda do sądu za działanie na Wiki jest raczej zerowa; także mało prawdopodobne są procesy przeciwko Fundacji. Jednak naruszenie prawa jest naruszeniem prawa, czy będzie ścigane, czy nie. Powinniśmy tego unikać w projekcie, nawet, jeżeli na co dzień któryś z nas jeździ samochodem szybciej, niż dozwolone, na przykład ;-). Z drugiej strony, miałem już doświadczenia z ludźmi mającymi żal za coś do Wikipedii i do tego nerwowymi, wolę nie tracić swoich nerwów.
- To, że mamy różne zdania na ten temat, wynika z niejasności prawa i zagmatwania materii. Nawet sądy mają z tym problemy. Powinniśmy wymieniać poglądy i wyjaśniać wątpliwości, bo nikt nie jest tu alfą i omegą. Marzę o świecie bez prawa autorskiego (mimo, że sam bywam autorem).
