Hallo Achatz1,
du hast eine Reihe von Bildern hochgeladen, die 1:1 Reproduktionen von Fotos oder Druckwerken anderer Urheber darstellen, die du aber nicht angegeben hast. Du hast als Quelle und Autor einfach "own" und deinen Benutzernamen eingetragen, was nicht korrekt ist. Denn bei einer Reihe der Fotos dürfte das Urheberrecht des Fotografen noch bestehen. Ok, als Neuling hast du es vielleicht nicht besser gewusst. Es ist nun deine Aufgabe als Hochlader, dies zu recherchieren. Erst mit diesen Angaben können wir dann hier bewerten, ob das ursprüngliche Urheberrecht noch besteht oder bereits abgelaufen ist. --Túrelio (talk) 09:56, 22 October 2021 (UTC)

Nun, ein Stift nimmt üblicherweise keine Kamera in die Hand und macht Aufnahmen. Aber wenn das Stift der Ansicht ist, dass es die umfänglichen Urheberrechte an den hochgeladenen Fotos hat (was voraussetzt, dass der tatsächliche Urheber seine Rechte dem Stift übertragen hat), dann sollte das Stift diese gegenüber permissions-commons-de@wikimedia.org (OTRS) rechtsverbindlich erklären. Dazu müsstest du den eingerahmten Text auf Commons:E-Mail-Vorlagen#Einverständniserklärung_(Rechte-Inhaber) kopieren, die Dateinamen (oder die komplette URL von Commons) der betreffenen Bilder sowie den Namen der gewählten Lizenz einfügen und an denjenigen im Stift senden, Prokurator?, der bei einer Firma ungefähr der Rechtsabteilung entsprechen würde. Er sollte sich das ganze durchlesen und, im Zustimmungsfall, seinen Namen und das Datum daruntersetzen und an die o.g. Adresse mailen. Allerdings wäre es m.E. sinnvoll, dass du, wie oben bereits, zunächst einmal recherchierst von wann genau die (Original-)Fotos stammen und ob sich die echten Urheber (Fotograf) ermitteln lassen. --Túrelio (talk) 15:30, 22 October 2021 (UTC)

Hallo Achatz1, das ist eine Reproduktion eines Fotos von 1957. Ich gehe davon aus, dass das Originalfoto vor 64 Jahren nicht von dir aufgenommen wurde. Wer war dessen Fotograf? Das Urheberrecht dauert bis 70 Jahre nach dem Tod des Urhebers. D.h. bei einem 64 Jahre alten Foto besteht es weiterhin, selbst wenn der Fotograf am Tag der Aufnahme gestorben wäre. --Túrelio (talk) 09:56, 22 October 2021 (UTC)

Dieses Foto ist mein Privatbesitz. Ein anderer Scan davon war bereits 2020 unter dem Titel "Der große stille Sportsmann" in der Passauer Neuen Presse veröffentlicht. Die würden das nicht machen, wenn sie es nicht dürften.--Achatz1 (talk) 07:28, 23 October 2021 (UTC)

Für die Presse gelten andere Spielregeln; die stellt ja nicht den Anspruch auf, dass die von ihr abgedruckten Fotos unter einer freien Lizenz stehen würden, die jedermann die kostenlose Benutzung erlaubt. Insofern musst du schon etwas genauere Angaben machen. Mit "Privatbesitz" meinst du vermutlich den Fotoabzug auf Papier, ja? Der spielt für das Urheberrecht aber keine Rolle. Entscheidend ist wer das Foto aufgenommen hat. Für mich sieht es nicht gerade wie ein Foto aus, das ein "Privatmann" geschossen hat. Vielleicht finden sich auf der Rückseite des Fotos Angaben, die Schlußfolgerungen auf den Urheber zulassen.

Ich kann verstehen, dass dich meine Fragen vielleicht überraschen und/oder nerven, weil du doch nur den Wikipedia-Artikel über deinen (vermutlichen) Vorfahren illustrieren wolltest. Das Hochladen eines Fotos unter einer freien Lizenz auf Commons ist aber ein verbindlicher Rechtsakt, der Folgen für dich und eventuelle Nachnutzer haben kann. --Túrelio (talk) 07:50, 23 October 2021 (UTC)
