It is important to know who created the images. It seems like not you created the images yourself but someone else, maybe the mothers of this children. You uploaded the images to your flickr and claimed them freely licensed under cc-by-sa-2.0. Only the copyright holder (the photographer) can provide this licensing. The licensing allows everyone to reuse the images everywhere, every time and for every purpose including commercial or money making purposes. Hello, My name is Rita and I'll try to explain why ALBA Lactancia Materna does have the right to use these images. ALBA Lactancia Materna is a non-profit organization that promotes breastfeeding (it`s similar in many ways to La Leche League). The images user Laialba is trying to upload have all been created by mothers who attended the support groups of ALBA Lactancia Materna, so there are no "photographers" as such. They all have agreed to licence these images for the promotion of breastfeeding, so there is really no problem of copyright.

I believe there`s been a misunderstanding, probably due to a mistake in the way Laialba initially uploaded the images (not as ALBA Lactancia Materna but as a private user). But the fact remains that Laiaalba is authorized to use some of those images and upload them, since she is the original copyright holder.

So, we have several people that have licenced the use of their personal breastfeeding images and a non-profit organization that is intitled to use them but, due to a technicality, it looks like it's not. How can we solve it? Some of the people that licenced the use of their images are no longer in touch with ALBA LActancia Materna (kids grow, stop breastfeeding...), so it would be really difficult to get written permission from all of them.

"For the promotion of brestfeeding" is not free. Images on Commons must be free to use by everyone, everywhere, every time, for ever and for every purpose. That includes commercial or money making purposes, that includes the promotion against breast feeding, that includes every other possible or not yet possible or imaginable use of the image (inside the legal restrictions of e.g. personality rights). You need written permission from the copyright holders, otherwise the images cant meet the requirments. I dont think one of the woman want to see her self, random example, in a commercial promoting in vitro fertilisation using photographs of mothers and her babys. --Martin H. I understand your reluctance, but we do have the right to use those images as we wish, I'll try to explain. In fact, ALBA Lactancia Materna has hundreds of images of breastfeeding mothers that publishes on the Internet under "CC licence attribution noncommercial no derivative works", you can see it for yourself in www.albalactanciamaterna.org. When Laialba asked us, ALBA Lactancia Materna, if we could licence some of our images to Wikipedia with the purpose of illustrating information about breastfeeding, after weighing up the pros and cons of it, we decided to agree on displaying certain images and thus changed the licence to "CC attribution share alike". All the chosen images were previously licenced to ALBA by the authors and copyright holders to be used as we wished. We understand, then, that those images were correctly uploaded to the wikimedia commons through the Flickr of the organization.

Do you still believe we need written permission from the copyrigh holders?

Yes, and thats the problem. They publish under Creative Commons Attribution Noncommercial No derivative. Commercial reuse is forbidden, it is not allowed to modify the image. You have no rights to license the image under a different license allowing for commercial reuse and derivative works.
The required licensing terms on Commons are clear: Free to use by everyone for every purpose including modificationa and commercial reuse. Summary: You are not the copyright holder, the images are licensed not free by the copyright holder, without the copyright holders written permissions you can not distribute the images under a Creative Commons Attribution Sharealike license allowing for forms of reuse (commercial reuse, modification) the copyright holders never agreed too. I honestly ask you: How is it possible that you forwarded a permission for all your images if you told yourself, that contacting the various authors would be difficult... I see some disrespect of copyrights and of the rights of the depicted persons to decide themself where their work (and their appearance) is wanted or not. The information about this is not below. There's only an e-mail address, that's not the form I was asking for, but never mind. Of course I said it would be difficult to contact SOME of the authors, but not all of them, fortunately, including myself and other people whose images we can and will use. Now I honestly ask you: how can you be so suspicious and assume that we're disrespecting the rights of others??? We're only trying to comply with your instructions, but I must say we're not finding too much understanding for your part. It's hard enough having to explain myself in a foreing language, but having to fight prejudices is certainly something I didn't expect to find here. Rita.

With your upload and licensing on Flickr you already disrespected others right and you already tried to upload it to Commons with the wrong information (writing your name as the author, giving your flickr account as the source)! What you call disrespect is pure and simple ignorance for our part. We've made mistakes, no doubt (probably led by a very Spanish habit of bypassing problems instead of solving them), but that doesn't mean we're trying to rob anyone. So:

  • Whats the source now, the correct source! We accept flickr as a source but not to evade problems or to hide the correct source. Who is the author!
  • Did the copyright holder allow for commercial or money making reuse?

A ver, espero que me entiendas porque yo el ingles apenas. La foto de LACTANCIA EN TANDEM 1 fue presentada a un concurso organizado por NODRISSA (una asociacion) con los derechos cedidos por el hecho de concursar. NODRISSA cedió bajo licencia CC parte de su fondo fotográfico (entre ellas la foto de LACTANCIA EN TANDEM) a ALBA LACTANCIA MATERNA (otra asociacion) y ALBA LACTANCIA MATERNA ha decidido subirlas a FLICKR y a WIKI. Todo es correcto, las imagenes se pueden subir bajo licencia CC. Primero lo intenté a titulo personal (laiaalba) pero no me lo aceptaba y luego lo subi como asociacion ALBA LACTANCIA MATERNA y me lo aceptó. Que problema hay ahora¿?? Is Alba lactanca the author? Is Flickr the source? No, both information is wrong. Correct the source and forward your written permission from the correct copyright holder to OTRS as requested above. The image was first uploaded as File:Oriol2000.jpg with the author and source "santi". So who is the correct (!!) author and source. Yo cedi esa foto a ALBA LACTANCIA MATERNA una asociación a la que pertenezco para que la usara para difundir la lactancia bajo licencia CC. O sea que tanto a titulo personal (laiaalba) como en nombre de la asociación ALBA LACTANCIA MATERNA esa foto es libre, puedo subirla a WIKI sin problemas, de hecho puedo hacer con ella lo que quiera.
