經濟部智慧財產局函釋

依著作權法第11條規定：「受雇人於職務上完成之著作，以該受雇人為著作人。但契約約定以雇用人為著作人者，從其約定。 依前項規定，以受雇人為著作人者，其著作財產權歸雇用人享有。但契約約定其著作財產權歸受雇人享有者，從其約定。 前二項所稱受雇人，包括公務員。」因此，公務員於職務上完成的著作，若無特別約定，以完成著作之公務員為著作人，而著作財產權則歸該公務員任職之公務機關享有；此時，公務機關將其享有著作財產權之著作，依國家發展委員會推動的「政府網站資料開放宣告」授權他人利用，並無違反著作權法規定。
