For questions regarding whether or not a photograph is considered published according to copyright law, a good resource to review is on the website of the American Society of Media Photographers where the terms published and unpublished are defined in a Q & A format. Another excellent guide is available at Commons:Hirtle_chart.
"For images distributed to news organizations by the Associated Press the copyright is held by the Associated Press. Associated Press images before 1929 are in the public domain. Associated Press images distributed to news organizations in the United States between 1929 and 1963 did not have their copyright renewed and are also in the public domain. The Associated Press did not renew its copyright for articles or photographs published prior to 1964, and the window for doing so has been closed for many decades. Content published from 1964 to 1989 may or may not be under copyright; it is worthwhile to search the registration database yourself to determine whether or not copyright was registered."
