Português: A decisão foi tomada durante análise da Ação Direta de Inconstitucionalidade (ADI) 4543, apresentada pela Procuradoria Geral da República (PGR). A Procuradoria questionava o artigo 5º da Lei 12.034/2009, que criou o voto impresso a partir das eleições de 2014.
A ministra Cármen Lúcia, relatora da ADI, votou pela procedência da ação. “Se não há de prestar contas porque o ato é personalíssimo, o papel [do voto impresso] servirá para quê, num sistema que permite e que se dota de mecanismos de controle como demonstrado centenas de vezes?”, questionou a relatora. O plenário reafirmou os fundamentos apresentados no julgamento da liminar, em 2011, quando entendeu que o dispositivo contestado compromete o sigilo e a inviolabilidade do voto, assegurados pelo artigo 14 da Constituição Federal.
