The original image was put both to Picasa & Flikr. Picasa is preferred in this very case but unfortunately the contributor was not familiar with UploadForm and chose "From Flikr". Sorry for this mistake. B7elijah (talk) 20:27, 6 September 2011 (UTC)[reply]

The painter is K.Seleznev's wife. K. Seleznev kindly provided the photo and wrote an OTRS letter. I believe he had all the rights to do that.

Thanks for your reply. Okay, then we need a license/permission (please see COM:OTRS) from the painter. We do only need a license/permission from the photographer if there are 3D parts photographed. Just a reproduction of the (2D) painting is not regarded as being a action which can be copyrighted. However, a permission from the photographer (although he should not claim attribution (→ PD-self) since it probably not valid - as I explained) is more safe. Yes, if the painting is not public domain (e.g. because the painter is dead more than 70 years) we need to get a permission (a release under a free license from the painter). Details of this process are on COM:OTRS. If we do not have a permission a photo of a painting is a DW and has to be deleted.
