This image does not belong to the uploader as it is stated ([1]). In the source section is written in Greek: Αποστολή με E-Mail στο garitatzis@yahoo.gr από την δημιουργό των φωτογραφιών κ. Νεκταρία Καρακλά which is translated as E-mailed to garitatzis@yahoo.gr from the creator of the images ms. Nektaria Karakla. This image is also found in the web ([2]) - though with lower resolution. Is there a copyright violation in this case? Can we prove that the original photographer consents in the stated licence? Thanks in advance, Texniths (talk) 19:09, 18 January 2020 (UTC)[reply]

  • comment Probably, dear Texniths, as the metadata indicate, the photographer seems to had her photo e-mailed to the uploader. But this does not nesessarily mean concession for someone else to have her photo published with the licence required by Commons. The e-mailing might have been for private use only, or for a specific use with another licence. It's her who has to give the proper licence, not the uploader. ǁ ǁǁǁ Chalk19 (talk) 07:30, 22 January 2020 (UTC)[reply]
So, dear Chalk19, should we ask for an OTRS? The user uploaded a series of images of Nektaria Karakla, e-mailed to him.--Texniths (talk) 07:39, 22 January 2020 (UTC)[reply]
@Texniths: I think yes. Even if we may assume a "tacit" agreement from the photographer's part it is not advisable to accept the images without obtaining the licences required from her personaly. ǁ ǁǁǁ Chalk19 (talk) 07:46, 22 January 2020 (UTC)[reply]
@Texniths: The above is correct. We will need some way to verify the license, whether the author does this publicly online or privately via OTRS. But the author themselves will need to do it. We cannot accept unverifiable licensing done on someone else's behalf. GMGtalk 17:51, 22 January 2020 (UTC)[reply]
@GreenMeansGo: Thanks for your response. As you may already have noticed, the OTRS procedure is on, so we just have to wait for it.--Texniths (talk) 18:04, 22 January 2020 (UTC)[reply]
