The Imperial Museum of Petrópolis (Brazil) cannot claim the copyrights, because there is a Federal Law in Brazil that states that the copyrights expires 70 years after the death of the author. In the case, Pedro Américo died long ago. There is no sense in the appointment made at this file. --Tonyjeff 13:35, 6 March 2007 (UTC)
Also, the image may be found here, so, I think, it's reinforced as a PD image, according to what is written here. There is no need to put all this explanation about the Imperial Museum in the file description, the fair use and so. It is not fair use. --Tonyjeff 14:04, 6 March 2007 (UTC)

- This is a obvious {{PD-old}} + {{PD-Art}} + {{PD-Brazil-media}}. The United States have the Bridgeman_Art_Library_v._Corel_Corp. and Brazil have the definition of a derivative work as means that which, while constituting a new intellectual creation, is the result of the transformation of an original work;[1].
