No copyright violation[edit]

As already explained to Eliane Daphy here, though I agree French copyright law may have applied on top of patent law, the artistic content of this industrial handkerchief produced by Bianchini-Férier and sold by Charvet in 1915, would have been, for copyright issues, a "collective work" as defined by article L. 113-2 par. 3 of the Code de la Propriété intellectuelle. According to article L. 113-5 of the same Code, the copyright owner is assumed to be the party who "divulgated" the product, i.e. the company Bianchini-Férier. In any case BF acquired all (possible) copyrights from Dufy and registered the pattern (see details at deletion discussion). In such case, according to article L. 123-3 of the same Code, the duration of the copyright is 70 years from January 1 of 1916, the year following its publication, and the work is since 1986 in the public domain. — Racconish Tk 08:40, 6 December 2012 (UTC)[reply]
