The name in the file (Dargaud) is under copyright, so the file is not free and is violating the law, and for that reason it only can be used under Fair use.

That was strange for me to but I have asked to the company and the answer was that the name is a trademark and because of that the image (of the logo) is under copyright.

May be they don't know by themselves. But in most countries a small portion of text or a simple word is not copyrightable (totally independent from trademark). It is a French company and in the wiki fr is Copyrighted
