High res

[edit]

I disagree to upload the high res version. The image was uploaded to en.wp by the copyright holder, see log, it was transfered to Commons November 11 2006 and reviewed as licensed on Flickr cc-by-sa on 27 November 2006. Ok, at this moment it was allowed to take the original size from Flickr. The cc-by-sa-2.0 on Flickr was last reviewed on February 19 2007, see User:Para/Flickr/Licensing differences/Compatible, but larger size was uploaded later on March 6 2007, and it was not reviewed what the copyright status was at this time. The licensor reserves the right to [...] stop distributing the Work at any time; provided, however that any such election will not serve to withdraw this License - thats the case here, the licensor stoped distributing the larger size of the image on Flickr under cc-by-sa-2.0. That was what AndyNugent answered me on Flickr at the time I asked him. We have the small size correctly licensed but no evidence that the larger size was still licensed under cc-by-sa-2.0 at the time of the first upload here. --Martin H. The high res version was uploaded on Flickr December 23, 2005. So we know it has been licensed freely per Para's list. It is correst the high res was first uploaded on March 6, 2007 and that Para stopped checking on February 19 2007. We do not know when the license was changed on Flickr. It could have been changed in these 14 days but it could also have been changed after. Did you ask AndyNugent excactly on which date the license was changed? Please note that User:Husky is a trusted user and now you are saying Husy can't be trusted? I will ask Husky to comment on that. --MGA73 (talk) 22:21, 1 November 2009 (UTC)[reply]
Reviewing the version history again I found, that in fact the image was reviewed at time of upload. Cant say why i missed this, I allmost spent two hours now on this image, the incorect transwiki, the IP edits and so on. However, I had a friendly conversation with Andy on Flickr, he said that he wanted to help out Wikipedia with the image, but only the small size as he dont want the high res version used commercially. For that reason and upon request he decided to upload the small size to Wikipedia, he not has, and never had, the intention to allow reuse for the large size image. Maybe he licenced it freely by accident on Flickr, someone may revert to the reviewed version as of March 6, 2007. Knowing the authors intentions and having this fixed one year ago I cant do this. --Martin H. (talk) 01:12, 2 November 2009 (UTC)[reply]
