When should the {{Personality rights}} tag be applied...

Uploader User:Pava applied the {{Personality rights}} tag to this image.

I am mystified as to why this was done. The woman in this image has her back turned to us. So, she is unidentifiable. As I understand it, this tag provides legal advice, to commons' users, warning them not to use images in ways that suggest the individuals in our images are endorsing products or opinions. It seems crystal clear, to me, that there is no possible way any third party could claim extra authority in claiming this young woman endorsed a product or opinion, when she cannot be identified.
