in an error case from Mont-gomery County, in which the city solicitor of Dayton wasplaintiff in error, and the traction companydefendant in error. Judgment of the CircuitCourt was affirmed. The city instituted pro-ceedings in the Common Pleas Court for theinforcement of certain specifications of con-tract, claiming the company had violated itsfranchise in that it did not operate cars atsufficient intervals inside the city limits, thatit did not have tickets for sale on its cars, andthat it ran its cars at a higher rate of speedthan permissible. The lower court held thatthe company specifically performed its contractwith the city. The city appealed to the CircuitCourt, which dismissed the case. The citythen carried the case to the Supreme Court,and the judgment was affirmed. The United Railroads of San Francisco report total earningsof $482,403 for the month of February, 1904, as against $445,161for February, 1903, an increase of $37,241. HEADQUARTERS OF THE DUNEDIN TRAMWAYS lines. The first building is at Whitestown. It provides a wait-ing room which will shelter about fifty persons, and a storeroomfor freight. Between these two rooms is the office of the agent.It is the intention of the company to put these depots in eachtown of 500 or more inhabitants.
