This is a special proceeding instituted be-fore the Superior Court of New Hanovercounty, to divide a certain lot in the city ofWilmington, N. C, among the plaintiff anddefendants as tenants in common—and it ap-pearing to the Coun that Benjamin Tuckeris a necessary party to this action, and thathe is a non-resident and cannot, after duediligence be found in this State, and thata cause of action exists in plantiffs favoragainst said defendant. It is now ordered that the defendanBenjamin Tucker be and appear before theClerk of the Superior Court of New Hanovercounty, on Thursday the 17th of January,1895, and answer or demur to the complaintalready filed in this cause or ludgment will beawarded against said defendant according tothe prayer thereof.
