This is a derivative work created on a Mural Fest, Sheffield, Tasmania. An artist has created the painting in 6.5 days on the festival and it is not older than 2003, the year of the first Mural Fest. Freedom of panorama would only cover if the painting is permanently located, which is not the case. Hence, the photographer is not able to publish the photo as "public domain". We can host this file without a permission from the artist. Who is the artist? Would it be possible to contact the artist? Nillerdk (talk) 15:30, 17 June 2009 (UTC)
I doubt it would be possible to contact the artist but it may be worth trying the local authority archive copy at the Wayback Machine. I would argue that the way that the photo is not a derivative work, but a photo of an event, i.e. the 2003 Mural festival. The photo is taken at an oblique angle that would make it difficult to cut and paste the mural image on its own and key parts of the mural are obscured by furtinute and signage, meaning its usefulness as a photograph of the mural rather than its location is limited. -- Mattinbgn/talk 01:23, 18 June 2009 (UTC)
What I wrote above is slightly incorrect, but this is still a copyright infringement. According to {{FoP-Australia}}, 2D-works are only covered by FOP if permanently located and "works of artistic craftsmanship" (following the link on the template, it is clear that paintings are not covered).
