assination who were never discovered, encouraging by theirpresence, and aiding and abetting, Booth and his associates. There are good reasons for believing that the purpose of Boothand his fellow-conspirators was known to many, both in Canadaand the United States, who were interested in the destruction ofour government. It may yet happen that a sufficient amount ofevidence may be found to justify this, or some other writer, inmaking explicit charges that are for the present withheld. In regard to the persons above named who were put upon theirtrial, the writer will only say that, in giving an account of thegrounds of arrest in each case, he has stated the facts proven byunimpeached witnesses before the Commission, whose testimonygoverned the decisions of the court in their respective cases, andthat his statements of the facts in evidence will be found to befully vindicated by a critical examination and study of the testi-mony as given by Pittman in his official report of the trial. THE first question that presented itself to the government inregard to these prisoners was, as to what kind of a trial should begiven them, whether civil or military? The civil courts were openin the District of Columbia at the time, and had been all throughthe war. There was no question that a form of trial could be hadin the civil courts; but there was at the same time as little ques-tion that, under existing circumstances, such a trial would only-result in a miscarriage of justice.
