On the following day the bill was hur-ried over to the Senate, referred to Mr.Douglass committee, and by him re-ported back without amendment, on Feb-ruary 17th; but the session was almostended before he was able to gain theattention of the Senate for its discussion.Finally, on the night before the inaugu-ration of President Pierce, in the midstof a fierce and protracted struggle overthe appropriation bills, while the Senatewas without a quorum and impatientlyawaiting the reports of a number of con-ference committees, Douglas seized theopportunity of the lull to call up hisNebraska bill. Here again, as in theHouse, Texas stubbornly opposed it.Houston undertook to talk it to deathin a long speech; Bell protested againstrobbing the Indians of their guaranteedrights. The bill seemed to have no friendbut its author when, perhaps to his surprise,Senator D. R. Atchison of Missouri threwhimself into the breach.

One was that the Indiantitle in that territory had notbeen extinguished, or at least avery small portion of it had been.Another was the Missouri Com-promise, or, as it is commonlycalled, the Slavery Restriction.It was my opinion at that time— and I am not now very clearon that subject — that the lawof Congress, when the State ofMissouri was admitted into theUnion, excluding slavery fromthe territory of Louisiana northof 36° 30, would be enforced inthat territory unless it was spe-cially rescinded; and whetherthat law was in accordance withthe Constitution of the UnitedStates or not, it would do itswork, and that work would beto preclude slaveholders fromgoing into that territory.
