STATE OF NORTH CAROLINA THE NORTH CAROLINA GETTYSBURG MEMORIAL COMMISSION KNOW ALL MEN BY THESE PRESENTS: This contract made and entered into on this 31st day of March, A. D. 1928, by and between the North Carolina Gettysburg Memorial Commission, hereinafter known as the parties of the first part, and Gutzon Borglum, hereinafter known as the sculptor, Witnesseth: Parties of the first part have engaged said sculptor to design, model, cast in plaster and in bronze, a memorial representing and interpreting the spirit of the Southern Soldier, and particularly the troops of North Carolina in the Battle of Gettysburg. This memorial shall be completed and set in place by the sculptor within the period of fifteen (15) months after the date of this contract. Before the actual work on the memorial itself shall have begun, there shall be submitted to the North Carolina Gettysburg Memorial Association or any designated committee or person, drawings and models upon which the memorial shall be based, so that the general design and the spirit of the memorial shall have been approved before the work is begun. The memorial shall consist of a group of at least five (5) figures representing the Infantry charging across the field, expressing the energy and the spirit of the soldiers of that State; and these figures, accouterments, and all modeling related to them shall be in bronze. Figures of this group shall be nine (9) feet; the total dimensions of the group can not [sic] be given, but shall be in scale [?] with these dimensions of the figures and as represented in the model submitted by the sculptor and first approved by the Commission. The base under the group shall also be of bronze. The supporting masonry binding the group to the earth may or may not be exposed, as the judgment of the artist shall determine; but the immediate foundation under the group, to which the group shall be anchored, shall be of granite and descend into the ground beyond the frostline upon the location which it is placed. There shall be no supporting masonry of any kind unless so desired by the Commission and shall be optional with them. This, however, relates to accessories, granite slabs or markers and shall not interfere with the design. The sculptor and Commission agree to leave the matter of inscriptions to be considered as the work progresses and it shall not be determined upon at the time of the signing of this agreement, except that these inscriptions shall relate only to the monument itself and record the North Carolina troops engaged. For the purpose of preparing the work and for developing it to such a point as to be informative and sufficiently complete for the Commission to determine upon its finished character, the sculptor hereby agrees to create a comparatively finished design, one-fourth or one-fifth of the full size of the memorial, in perfect scale with the dimensions given above. This model shall be made in duplicate and one_f [?] then shall be sent to the Commission at such place as may be designated, to be retained by the Commission until the work is finished. These models shall be made in plaster from the clay model and shall be a development of the design submitted to the Commission and approved by it. The sculptor agrees to [unintelligible] all necessary negotiations for the Commission with the Battlefield authorities for the location of the memorial; and agrees also to conform to all rules and regulations that the War department or the North Carolina Gettysburg Memorial Association prescribe or may prescribe. The sculptor also agrees to set such markers at the corners of the plot as may be determined upon, in the nature of granite posts,
