Pay attention to copyright
File:Loď plachetnice.png has been marked as a possible copyright violation. Wikimedia Commons only accepts free content—that is, images and other media files that can be used by anyone, for any purpose. Traditional copyright law does not grant these freedoms, and unless noted otherwise, everything you find on the web is copyrighted and not permitted here. For details on what is acceptable, please read Commons:Licensing. You may also find Commons:Copyright rules useful, or you can ask questions about Commons policies at the Commons:Help desk. If you are the copyright holder and the creator of the file, please read Commons:But it's my own work! for tips on how to provide evidence of that.

The file you added has been deleted. If you have written permission from the copyright holder, please have them send us a free license release via COM:VRT. If you believe that the deletion was not in accordance with policy, you may request undeletion. (It is not necessary to request undeletion if using VRT; the file will be automatically restored at the conclusion of the process.)

Warning: Wikimedia Commons takes copyright violations very seriously and persistent violators will be blocked from editing.

Obrázek, který byl obviněn z plagiátorství je mým vlastním dílem. Doložit to mohu svými zdrojovými soubory. Moninacz (talk) 13:41, 31 July 2024 (UTC)[reply]
Hi @Billinghurst, I received a VRTS ticket from @Moninacz (Ticket#2024081010006121). I saw you deleted the image, because of the statement at https://www.istockphoto.com/legal/license-agreement?utm_medium=organic&utm_source=google&utm_campaign=iptcurl. That statement is a generic one of istockphoto.com, and I'm unable to find the same image on istockphoto.com using google images or similar. Would you mind providing a direct link to the image? I can't really see a reason to believe it would be copyright infringement (based on the information you provided here and in the page history), which makes it challenging to process a potential VRTS release (as I don't know what is the to-be-released material). Thank you for any clarification you can provide. Martin Urbanec (talk) 16:19, 11 August 2024 (UTC)[reply]

It looks like something has gone wrong with File:Loď plachetnice.png. Please send an email to Commons:Volunteer Response Team (I think there is also a Czech version) with proof that you made the image yourself, explain how it could become part of Istockphoto and ask if they put the image back in Commons or send it with the email. Refer in your email to this Talk page with the Notification of possible copyright violation. JopkeB (talk) 14:04, 3 August 2024 (UTC)[reply]

The issue then comes about that it is personal artwork, and also not within scope.  — billinghurst sDrewth 21:57, 11 August 2024 (UTC)[reply]
Hi @Billinghurst. The image was deleted as a copyright violation, not as "personal artwork" or under any other reason. As such, that's the question that needs to be answered at this point. The copyright status needs to be resolved before other questions, as that's now what "blocks" potential undeletion of the image.
Generally, copyright issues are fairly easy to resolve. In this case, this is unfortunately very challenging to do – neither the file history nor the deletion reason mentions why you believe the image is a clear copyright violation. The link you provided is the license statement of Istockphoto, not a particular image on that site. Having detailed information on this question would then make it possible to discuss the issue at an appropriate venue (either in VRTS, if the image indeed appears elsewhere, or on-wiki, if it does not).
Any potential issues with COM:SCOPE or COM:PERSONAL can (and should) be discussed once the copyright status is resolved (in one way or another). In my opinion, that would happen via a full COM:DR, as that would allow the community to properly judge the image and make a decision about it.
Would it be possible for you to clarify why you think the image is a copyright violation? If you no longer think the image is a copyright violation, would you mind undeleting it (as the original deletion happened on copyright grounds), and let the scope question be resolved using the regular process (in this case, presumably a COM:DR)?
Best, Martin Urbanec (talk) 17:13, 13 August 2024 (UTC)[reply]
The process for undeletion requests is expressed at Com:UDR and that is always the process to be used. All the possible grounds for deletion and retention should be brought into that discussion. Let us not step outside the community's processes.  — billinghurst sDrewth 22:29, 15 August 2024 (UTC)[reply]
I'm aware of the COM:UR process. Let me remind us what it says (emphasis mine):
If the reason given is not clear or you dispute it, you can contact the deleting administrator to ask them to explain or give them new evidence against the reason for deletion.
I did exactly that. As far as I can see, I'm following the process set by COM:UR, rather than somehow stepping outside of it.
That being said, since contacting the deleting admin provided no information at all, filling a formal undeletion request indeed makes sense. Please see COM:UR#File:Loď_plachetnice.png.
