File:Waddesdon Chapel.png has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

Wikimedia Commons does not accept derivative works of non-free works such as File:Borstal Boy.jpg. It only accepts free content, which is images and other media files that can be used by anyone, for any purpose. Reproductions of copyrighted works are also subject to the same copyright, and therefore this file must unfortunately be considered non-free. For more information, please read Commons:Derivative works and Commons:Freedom of panorama. You can ask questions about Commons policies in Commons:Help desk. The file you added has been deleted. If you believe that this file was not a derivative work of a non-free work, you may request undeletion.

@519Clarke: Please be advised that derivative works of non-free content are subject to speedy deletion per "3. Derivative work of non-free content". This file appears to be a derivative work which incorporates the copyrighted image "double barreled shotgun with both of the barrels smoking" from the website ShuttlecockShutterstock.com. Shuttlecock'sShuttestock's licensing page says "3. In the event that you create a derivative work based on or incorporating one or more Images, all rights in and to such Images shall continue to be owned by Shutterstock or its Contributor(s), subject to your rights to use such Image(s) pursuant to the terms and limitations set forth herein." Therefore, this image should not have been claimed as your "own work", rather proof that you have permission to upload the image to Commons from both ShuttlecockShutterstock.com and the file's original copyright holder Guy J. Sagi should have been submitted to OTRS for verification. Please refer to "If you are not the copyright holder" for more information on how to do this. Thank you. @519Clarke: This file has also been nominated for speedy deletion for reasons a given above for File:Borstal Boy.jpg. Please also be advised that this file appears to be nothing more than a scaled-down duplicate of "File:Borstal Boy.jpg" and, thus, may also be subject to speedy deletion per "8. Exact or scaled-down duplicate." - Marchjuly (talk) 05:20, 1 December 2014 (UTC)[reply]

This is not copy write violation as I have already informed you when uploading how ever isis the wrong file and do not know how to download it 213.104.226.208 07:39, 2 December 2014 (UTC)[reply]
Hi 213.104.226.208. I'm not sure why you are replying to this post. Are you, by chance, also 519Clarke? If you are, then please be advised that logging in and replying to posts using different accounts not only makes it really confusing to know who is talking to whom, but it also is something highly discouraged on both Wikipedia and Wikimedia Commons unless there is a really good reason to do so. Using multiple accounts might be seen as suspicious by other editors and could possible be considered "sock puppetry", which is something that could lead to a block or ban from editing. So, please try and use the same account at all times to avoid any misunderstanding.
Now regarding the file in question. It was deleted because it was a derivative work (please click here to see what that is). More specifically, this particular image was a combination of some of personal images and the copyrighted ""double barreled shotgun with both of the barrels smoking" from the website Shutterstock.com. Even if 519Clarke purchased the image from Shuttlecock, their licensing page clearly states "3. In the event that you create a derivative work based on or incorporating one or more Images, all rights in and to such Images shall continue to be owned by Shutterstock or its Contributor(s), subject to your rights to use such Image(s) pursuant to the terms and limitations set forth herein." In other words, I cannot take one of Shuttlestock's copyrighted image, use software to either alter the image in some way, or combine with some of my own personal images, and then claim the combination as my "own work". Although the image may seem different, it is still considered to be the same image and, therefore, its copyright needs to be respected. Therefore, when an editor uploads such an image to Commons, they need to email proof to OTRS that shows that they have permission from the copyright holder to use this image and that the copyright holder agrees to one of the free licenses that Commons accepts. Since Shutterstock makes money by selling images, it is highly unlikely that their images are released under a free license, so a copyright needs to be assumed until it can be shown otherwise. - Marchjuly (talk) 11:57, 2 December 2014 (UTC)[reply]
Hi, Yes I am 519Clarke I was unaware of any alternative log in procedure and thanks for the information I was unaware that the image in question was not allow so please ignore it.
Please advise if I am logging in incorrectly
213.104.226.208 13:47, 2 December 2014 (UTC)[reply]
OK 213.104.226.208: No worries. I never assumed that you were intentionally trying to skit any of Commons rules regarding copyright. Both Wikipedia and Commons tend to be quite strict when it comes to copyright stuff in comparison to some other websites, so something an editor has no problem uploading somewhere else, may not a problem on Commons. When in doubt, it might be a good idea to email OTRS first and just ask, or ask for advance at the Village Pump before uploading the image just to make sure it's OK to do so.
There is really only one way to log into Wikipedia or Commons that I am aware of. Just click on "login" at the upper right of page, enter "519Clarke" and your password, and you should be logged in as "519Clarke" unless there is a problem. If you have a registered Wikipedia account, then you can use the same account on any Wikimedia site (e.g., Commons, Wikipedia, Wiktionary, Chinese Wikipedia, etc.) without any problems. If you look at your reply above, you'll see that you were logged in as your IP address once again, so next time just log in as "519Clarke" and stick to that account. Hope that helps. - Marchjuly (talk) 21:52, 2 December 2014 (UTC)[reply]

@519Clarke: This image may be your "own work", but since a Google image search has shown that the same image has been uploaded to another website here before you uploaded it to Commons, there is no way to tell for sure who is the original copyright holder. Therefore, please refer to "I am the copyright owner but my picture has been previously published." Without any proof that you have permission to upload the article to Commons, the file may be deleted as a possible copyright violation per "Missing legal information". Thanks in advance. - Marchjuly (talk) 05:50, 1 December 2014 (UTC)[reply]

Update: This image is a little more difficult to handle than File:Converted on LSD.jpg and File:Converted on LSD 2ndEd.jpeg. If you look at the image's summary section you'll see that your email regarding it has been received. However, there is something missing from your request so "permission to use" cannot be granted at this time. Perhaps, you forgot to select a license for it or forgot to provide proof of permission from the any other copyright holders who might "own" part of the image. The first possibility is easy to remedy; Just email OTRS and specify the license you want to use or ask for help on the OTRS Noticeboard. The second possibility is a little trickier. It looks like the image is composition of different images taken from different sources, parts of which appear to be from a 1971 Bucks Herald article about you. If this is true, then the image is probably another derivative work, which means that some of it may still be protected by copyright. If this is the case, then you will need to provide proof that the newspaper has licensed the image in a way that allows it to be uploaded to Commons. If you are unable to do so, then the image, unfortunately, will most likely end up being deleted. Again if you are not sure how to do this please ask at the OTRS Noticeboard and someone will try and walk you through it. - Marchjuly (talk) 00:53, 5 December 2014 (UTC)[reply]

Please see this page for more information on how to confirm permission, or if you would like to understand why we ask for permission when uploading work that is not your own, or work which has been previously published (regardless of whether it is your own).

Warning: unless the permission information is given, the file may be deleted after seven days. Thank you.

@519Clarke: Proof that you have permission to use this image needs to be sent to OTRS for the same reasons given above. This image was uploaded to another website here prior to you uploading it to Commons. - Marchjuly (talk) 06:01, 1 December 2014 (UTC)[reply]

Update: More good news 519Clarke. The OTRS request for this image was also received and OK'ed. So, the image is also good to go. Please try and remember though that you have freely licensed this one too so that it may now also be used by others as well. -Marchjuly (talk) 22:16, 4 December 2014 (UTC)[reply]
