Trespass has no effect on copyright. The image rights belong to the photographer, even if he violated a law to acquire it. If the property owner wishes to swear out a trespass complaint against the photographer, they are free to do so, but this is not the forum for doing so. Magic♪piano 15:42, 8 October 2019 (UTC)[reply]
How would people know if there are "No trespassing" signs posted? How would we be able to check each photo? How could we be sure the the photographer did not have permission (written or otherwise) from the property owners? And if you think copyright law is difficult to wade through for different countries and time periods, trespassing laws for each state in the US, province in Canada, etc. would be much more difficult. Having photographers prove they weren't trespassing for each photo would essentially shut down Commons. Smallbones (talk) 18:41, 15 October 2019 (UTC)[reply]
