It is my maternal grandfathers photo. He is dead. And copyright do not exist in Denmark, the corresponding law is "Lov om ophavsret", and this image is outside of the borders of this law (it is not a work of art/artist). Only a judgment can demonstrable that. If commons been judge, the only penalty can been a remove of the image.
