Note: From this discussion with Admin Lupo, I will pass this image since this is an old 2008 image. Since 2009, all flickr/picasa/panoramio images would need OTRS permission. But this is not a 2009 image and there is a typed permission for the use of this image by the copyright owner for his photos on May 23, 2008 on this panoramio link here: http://www.panoramio.com/photo/5805613 which states “Affirmative,surement et avec plaisir l'honneur est a nous et tout ce qui peut faire du bien au monde et a wikipedia et nous sommes a votre service avec le plus grand plaisir .Amitiés Rached Msadek” & “Dacord cher DrFO.Jr.Tn mais ayez la patience de me les signaler s v p ,et si possible un petit renseignement sur votre honorable personnalitée car wikimedia on connait et votre honneur on a le plaisir de vous connaitre. Amitiés. Rached”...OR "If so, surely the honor and pleasure is ours and all that can do good in the world and wikipedia and we are at your service with pleasure. Friendships. Rached" So the uploader and the copyright owner clearly have a relationship.

So, the copyright owner gives permission for his photos to be used on wikimedia commons/wikipedia...and asks for attribution but never says the image Must only be used on wikipedia. There is no mention of a non-commercial or no-derivative restriction on its usage--just a request for attribution. This indirect permission should be acceptable in 2008 when the requirement for OTRS was not strict compared to 2009 onwards. The copyright owner was given a link to the image and has not complained about its existence since mid-2008.
