Das Foto ist von einer öffentlich zugänglichen Straße aus aufgenommen. In einer Entscheidung des BGH, der sogenannten "Friesenhaus-Entscheidung", wurde klargestellt, dass dies kein Eingriff in die Rechte des Hauseigentümers darstellt (BGH, Urt. v. 09.03.1989 - I ZR 54/87 = NJW 1989, 2251 = GRUR 1990, 390). Auch Bedenken hinsichtlich des Urheberrechts an der Abbildung eines Gebäudes bestehen nicht, da sich das Gebäude gemäß § 59 UrhG "bleibend an öffentlichen Wegen, Straßen oder Plätzen" befindet und eine Vervielfältigung mittels Lichtbild daher gestattet ist.
