fore thefirst of May. In beginning the con-struction of the nest, as if from somedefinite cause, all the birds seem tobe late on the same season. Mr. H.Gould Welbourne (see Oologist, Sept.1895), gives them as a common sum-mer visitor around Lexington, NorthCarolina, and describes a nest in theupright fork of a plum bush only fiveor six feet from the ground. On the20th of April, in Norfolk county, I ob-served a pair of birds building theirnests in the V shaped crotch of asmall willow at the height of 11 feetfrom the ground. The nest was visit-ed several times, and on May 5th wasfound to contain three fresh eggs.As in the north and west they arrive afew days later than in the south andeast, so, also, are they from three toeight days later in building theirnests. During the construction of thenest both birds share alike in thelabors, but the male seem to be de-void of that hustling quality that sowell marks the efforts of the female;even then he is far from being a lazy 118 THE 00L0G1ST.

The nest is placed on the hori-zontal or drooping limb of some treein a grove or heavily wooded tract, oroccasionally on the limb of a tree bythe side of a road, and more rarely inthe shade trees in the yard. Theirfavorite trees are oaks and sweet gums,on the limbs of which they place theirnests at heights ranging from elevento sixty-five feet from the ground; butfrequently do we find them on thelimbs of beeches, elms and other treescommon to our forests, and rarely inthe trees in the orchard and garden.The nest is often placed in the twigsthat shoot upward from the main limb,but in such a manner that it is seatedon the main limb, and is so firmlyseated in and around the twigs thatoften it is with difficulty that the nestis removed as it is woven around thetwigs.
