Under the terms of the 1909 Copyright Act the photo would have had to be renewed 28 years after publication. A search for copyright renewal records of 1958 ([2], [3]) reveal no trace that this occurred. It is likely that the image was never copyrighted - see for instance this scan of the back of a promotional image for the same film, without a proper copyright notice.
