Description
Čeština: * Anulování rozsudku německého zemského soudu, kterým byl odsouzen k trestu smrti Josef Churavý.
  • Usnesení; Krajský soud trestní v Praze, odd. VIII., usnesl se dnešního dne v sedění neveřejném slyšev státního zástupce v trestní věci proti Josefu Churavému (dne 27. října 1894 v Olomouci rozenému, ženatému, plukovníku generálního štábu, posledně bytem v Praze-Žižkově, Lucemburská 35), který byl rozsudkem zvláštního soudu u bývalého německého soudu zemského v Praze ze dne 6. srpna 1940 pro sabotáž a nevěrnou správu odsouzen k trestu smrti takto: Rozsudek shora uvedený prohlašuje se podle článku 9 odstavec 2 dekretu presidenta republiky ze dne 3. srpna 1944 za nicotný, ježto rozsudek byl vynesen v době nesvobody a odsouzení se stalo pro trestní skutek, který nebyl a není trestný podle československého práva.
